The problem comes when a person's actions outside of work begin impacting the business. Ignore for the minute the risk of negative pr, loss of sales, etc and focus on the potential liability. If a person, on their own time, makes a public statement like "I'm going to drive over any protestor that gets in my way" and the company becomes aware of it and doesn't take action, then the company has tacitly approved of the statement and can be held liable. I'd also point out there is a difference between saying "I think Fruit Loops are better than Lucky Charms" and "I think anyone who eats Lucky Charms deserves to die" and "I want to shoot people who eat Lucky Charms". There's also a difference between saying something to one person and saying it to the entire world.
Ummm hes hauling hazmat so no he cant go other routes, hes limited to the hazmat route only, so sit down, u obviously know anything about truck driving or the rules....
Actually around the Twin Cities there are alternatives. Usually though in my company we’re routed around Minneapolis and St. Paul via I-494 or I-694. If we do go into either city we only go certain routes since there are truck prohibitions on both I-35 E and I-35 W because of tunnel height restrictions.
First he's a local fuel hauler, I believe, so he should be familiar with the roads which offer at least 6 alternate interstate quality routes. Also, to the best of my knowledge the M-SP area has very few hazmat restrictions. Second, the temporary shutting down of a roadway does not by itself constitute a violation of civil rights.
The simple solution: don't put yourself in that situation to begin with. I've watched several of the videos of the truck driving into the group. He chose to be Billy Bigrigger and drive into the crowd. The crowd clearly did not form around him. He could easily have stopped well short of the protestors, called the police and gotten out of that situation without incident.
Our country was founded upon a series of "crimes". Civil Disobedience is one of the most powerful tools to instigate change.
We are free to move and he was working, so therefore no u dont have a right to block a highway and interfere with a drivers travel.....no ones rights trump another, especially when they obstruct the drivers movement......
