Walmart manager hit my leg with metal dock bar. Serious Suggestions?

    I agree he shouldn't be acting the way you say he was. While I don't think you should have been recording that doesn't change the fact he was acting stupid and you got hurt.

    Just how hurt did you get though? Unless you're permanently affected I think you overdoing it by suing.

    Doing your job doesn't require to record someone without their/company permission (loading dock isn't public domain) just to get your jollies on YouTube.

    WM lawyers will get your video thrown out of court for that reason. The only admissible video will be what is on the dock cameras.

    Hurt enough that I was on the ground unable to do anything for 10 minutes and had to get it checked out by the hospital.

    You have to understand that this was a big dude.... 6’2 and 300lbs. Surely he must have known someone his size would do great damage with a metal pole in his hand throwing it with so much force.

    Again, how do you think I felt being in that dark trailer with him while he was taking out his frustrations on the malfunctioning pallet jack? The guy was savagely jamming the jack into each pallet while swearing like a sailor.

    Read your first post again. The guy appologizes and says that he didn't see you there. Now you are saying that he threw it at you. What is the footage going to show? Him blindly throwing something and you accidentally getting hit or him throwing it at you on purpose?

    He apologized because he realized he went to far and his temper got the best of him..... not my problem.

    People will say anything to not get fired/damage control, but the footage tells all.

    Sounds traumatic. Have you told the lawyer yet that you get scared now every time you see a WalMart or the inside of a trailer? You'll probably never be able to work again. Don't forget to mention the nightmares also. :|

    Agreed, but that would only differentiate between an accident or assault. The dock worker will be liable for one or the other.

    That is correct but I bet accidentally hitting someone pays alot less than intentionally doing it in the eyes of lawyers.
