30m break in a daycab (I’m sure this has been answered already)

    My company runs day cabs out of Virginia. About as far as we go is into Philly and some small towns out in Jersey. I was getting unloaded the other day and I was 1 min from exceeding my 30min break. I went ahead and went off duty so I wouldn’t violate. Is there a general consensus on what should be done in that case? Can you be off duty while unloading? I’m not doing anything with the truck or unloading it. Just sitting there staring out of the window. How is being off duty at a dock and doing nothing any different than being at a rest stop doing nothing?

    I do the customer check- in thing, then off-duty. You were short on time so you did what needed to be done. You will get or could get a lot of different opinions on this subject. I watched some you tube folks discuss this, seemed like everyone has a different way of showing half hr. breaks. Some said that its illegal to go on break at customer, because what if you have to go inside, or watch them load, or stay out of truck and set in drivers area. You have a daycab, so like you say, stare out window at customer , or stare out window at rest area, or at truckstop? Or watch tow motor go in and out of trailer? None to me. What if i am on break, and have to go to potty, should i go back on duty? Jk.

    If you were getting unloaded it doesn't matter how long you have worked. HOS wise, you won't be in violation as long as you take a break before you go back to the drive line.

    I agree that you're going to get many different answers here. Personally (whether right or wrong) When I get to a shipper or receiver, if they do not have any special rules, like stay in truck or go to break room etc, I get in the sleeper, turn on the TV & sometimes nap. So, I log sleeper.
    If a DOT guy rolls me up & says I cant do that, & writes me a ticket, then at that time I'll go from there. But until I KNOW that I can not log sleeper when I am in the sleeper, I'm gonna keep logging what ever it is I do.

    If the shipper/receiver says I have to go to the break room, then I'll get a snack, log off duty & call it lunch. If DOT says I cant log off duty during loading/unloading, then I'll go from there at that time.

    Just me though......

    I'll say this though, I've been out here fooling with DOT for about 25 years & been inspected more times than I care to think about & its never been an issue. But, of course, that was before this precious ELOG crap.

    Remember....
    even when your on a 34 hr reset if you happen to remember you need to pick up a screw for that missing dash screw because the rattling is driving you insane.
    You just legally went on duty and now have to start your 34hr reset all over again.
    Why just the other day on my 34 hr reset I drove over to the truck to pick up my phone I left there.
    as I was getting out of the truck I noticed the hood latch was undone.
    Stupidly not thinking I latched it.
    I was already 24 hrs in to my 34 and had to re start it all over again because I went on duty when I latched the hood.

    just dont be in the fuel lane or the pull up lane when taking a 30

    Hmm okay. Guess I’ve just been over thinking it. Dumbest part of the HOS now days in my opinion. I’ve never encounterd another truck driver in my time of driving that has said to me “I sure do wish we had 30 mins off to not get paid and twiddle our thumbs”.
