Application and non convictions

    Hello,

    Asking for my brother
    Question about the application process and weather a non conviction needs to be mentioned.
    In November he was arrested, pulled over for window tint. Officer claimed marijuana and some sort of pills.
    Charged him with 3 3rd degree felonies .
    Now, he could have fought it but they offered him Pretrial intervention. So he wasn't convicted.
    So, that won't be on his record. But the arrest is still there.
    How should he handle this.?
    He's worried because the recruiter hasn't run his background check yet till he arrives on site.
    Your thoughts?

    some applications ask, "have you EVER BEEN ARRESTED"?

    he may not have been convicted, but it'll still show up on a back ground check.

    so DO NOT LIE on an application.

    my "brother" told me to tell you this.

    My brother said if no marijuana or pills he would have fought it.

    Thank you for your reply,
    So if application asks about arrests and he mentioned it would this be a deal breaker if he wasn't convicted?
    Or would they likely look beyond it since he was open about it?

    they may ask when it was finalized, what it was for, etc.

    just do not lie on an application, and omitting information, and they find out later and they will, they will deny him a job for, well, lying.
