can i contest a dot inspection write ups in court.

    Yesterday I got pulled in the MO scale house. I got random dot level 1 inspection. I got written up for not having "US" in front of "DOT" and I also got written up for the trailer ABS light not illuminating on the dash when you turn the truck on but the tractor ABS light worked, since she didn't know if the trailer was causing it, or the truck she written it up on both of them, so a total of 3write ups but no ticket, I'm only a one truck owner operater with my own authority and I'm wondering if I can contest this in court once I fix it. Btw since I just got the prepass, will it always light up red after this when I go over scales (of course my weights being ok on the truck and trailer).

    DATA Q. Good luck with the "US". regs are pretty clear on that. What was the ABS #'s?

    As Chris says, you can contest it on the Data Q process on the SAFER website - only tried to contest something once and it was a "gray" area type thing, the officer reading my challenge on the Data Q thought it was a darker shade of gray than I, and I was stuck with it. If you haven't had any other issues then no you will still get a green light most of the time. Monitor your compliance numbers on SAFER to see what percentage you are in and it will give you a good idea of how frequently you will get pulled in.

    Did the dash light come on and then go off when the key was turned on? When the brakes were applied did the trailer light come on and then go OFF? If so then DATA Q it, Doesn't hurt.

    as you didn't get a ticket what you going to court for....????

    a ticket you could go to court and fight but a warning.... as you haven't been changed with a crime (ticket) their is nothing you can do about it

    The truck light comes on and goes off, but the trailer light don't come on and go off it stays off, but I got written on on both of them.

    I seem to remember reading, maybe here, that ABS is not required equipment so there cannot be a violation if it's not functioning properly. OTOH I'm an old fart so it's possible a brain cell or a few have gone adrift...
