    There seems to be a lot of conflicting information online and from DPS and the DMV. Here is my scenario;

    I am in an L2 EAD holder and I have never had a CDL in Canada and have moved to Texas and to try and get a job in the oil patch here it seems I need to obtain a CLP and get to learning.

    I will be employed with SLB so the CLP is all I need to to obtain by myself and they will take care of the rest.

    My problem is in the wording of the text on the website of the DPS. It states I cannot obtain a Texas CDL if I have a Canadian CDL, which I do not, and the employees of the DPS seem to be lost in translation, yet when I call into their Austin head office branch they tell me all is good.

    I have already obtained my SSN and Texas Class C license that is pinned under the “Limited Term” stamp which is all good, I have my medical and all the paper work needed to write the CLP test and have studied extensively.

    Now that I have explained myself, what the hell do I need to do to get it done.

    Have Austin fax or call the locals. Or, just keep going back and butting your head.

    They told me every branch location can make its own discretionary decisions. So doing that won’t make it work. I think my best bet is to go in to a small branch and try again, I have 2 weeks to kill so who knows. My main concern is to know that I can actually do it and that someone has done it and I’m not crazy for thinking I can.

    I don’t know where you are. But if you’re close to Midland or Odessa, give them a try. They’re used to handling the weirdness that is the oilfield.

    I’m in Arlington but I will definitely test all avenues. Who knows might just need to do it with a company rep, I mean I’ll give anything a go at this point.

    Try the Denton office. They are very helpful and courteous. Just expect it to take a few hours.

    If you come out here to the Midland office, unless you have a pre-scheduled appointment time, you will be there all day. It is just like Walmart; 35 lanes and only 5 are open.

    Poppycock, you either qualify for a Texas CDL or you do not. If you do not there should be clear language why. If that language is there it applies to ALL DMV locations statewide. A local DMV office will not be given the authority to determine this either. They may have the power to accept proof or not, but the law is clear and there is no local discretion.. Go back to that DMV ask for a supervisor and get that supervisor to go on the record and tell you clearly no CDL then get their name and report them.

    I recently was made privy to a situation right here in my home where someone was told at the Hampton Virginia DMV they could not get a CDL because of something I am not at liberty to disclose. They got Richmond involved and Richmond gt the situation fixed.

    There is no local discretion, just local idiocy!

    The Weatherford office isn't very big and they do a lot of cdl testing there.

    DMV and DPS in Texas are two separate entities, the DPS does have its own discretionary authority, and that’s where the testing is done. The supervisor at said DPS outpost was portably miss informed of my situation because of the mass amount of people that are in there. I always call ahead our go online to get inline etc so the line up doesn’t matter to me.

    My issue is clarity. I need to find a Canadian who has done this before in Texas. My search looms on.

    Texas DPS seems to be the only one that gives people a lot of greef. But I’m willing to wade through the crap and make it happen.
