I was hit by a driver who made an unsafe lane change and drove right into my front end, captured on my cam. I showed the video to the responding officer, and later to Werner safety at a terminal. Safety wanted to charge me with a preventable, require remedial driver training, and a pile of cbts. I told them, Don't bother, I don't work for you anymore. Two weeks later I received the officer's report assigning blame to the other driver. CYA people, because Werner will throw you under the bus.
Werner lost a lawsuit for 90 million when the wreck was 100% the other drivers fault. Do you blame them for being paranoid?
I do. The Werner safety team seemed a bit too quick on the draw since it took two weeks for the blame game to be played out. Prematurely assigning blame didn't earn Werner a dime of that 90 million back.
Yep. I am not saying this applies in your case. But an accident that the other driver was determined to be at fault can still be a preventable accident or your part. Is there something that you reasonably could have done to avoid the accident? If so, it is a preventable, regardless of who is at fault.
It sounds like you're saying blaming their own driver is Werner's way of covering their own ###. The judgement against Werner was overturned. What do you think would have happened if they had charged their driver in that accident? Overturned verdict? No. You're argument makes no sense.
Except it hasn't been overturned yet. It's still going on. When I posted it was dismissed, I guess that wasn't the end of the case...
