We had an accident on Dec 16,2013 there wasn't anyone involved.We didn't receive a ticket and it states there were no violations on the report.The DOT didn't inspect the truck til Dec 17,2013 at the wreak yard.We were not there for the inspection and didn't receive anything in truck or by mail. Is it legal for them to put points on a CDL without knowledge?The points they put on were from the wreak.The points that they put on were things like hood not properly latched,turn signals not working etc.which were all due to the wreak.The truck was totaled.Is it legal to do this type of inspection the next day?Can they not inform you of this?Thanks
Its a big point of contention with CSA rules. Companies and drivers are penalized even with a non preventable accident. OOIDA has been in contact with Congressmen sympathetic to truckers, we will see what comes of it.
It's impossible to get points on your MVR without a ticket. You must be thinking about CSA2010 and your PSP score. There has to be an inspection report with that. Find out who done the inspection and call them for answers.
Well I beg to differ ALL my point have been give to me without a ticket give to me. IF you receive an inspection report then any abnormality a sighted on that report will give you points for that abnormality. When that cop/dot says" no this won't go to your CSA score he is uninformed. Oddly enough ugh the one ticket I did get never has showed up on my CSA.
tickets don't show up on csa. only inspections. and that's kind of chicken sh-- for dot to do that. it was probably a perfectly good working truck. hey, i see a wrecked truck. let's go see what violations we can find and put some points on someone's record. HMPH.
I got my psp at MATS and the wreck( loose wheel hit ton truck) was on there. Was no ticket or inspection and no points for wreck.
On a post-crash DOT inspection, any violations that are the result of the crash should be marked as such on the inspection. What points are you talking about? You have your MVR points with your state with it's points issued from tickets and you have CSA2010 with the feds and your PSP basic score coming from inspection reports. Two different score systems. Drivers can get tickets with out inspections that only go on the MVR. Drivers can get failed inspections without tickets. Them scores go to the PSP. Then you have the tickets with the bad inspection report. Depending on what it is like no seat belt then most likely you will get a double banger with scores going on both records.
