I am soon hiring an driver for a dedicated load that i secured with a broker. I do not know him personally and I want take some precautions. This driver does dispatch for himself from the load boards and he would like to work with us if I can get better rates and dedicated business, which I can. Now, what I don't want to happen is him taking the dedicated load from us for a cheaper rate screwing us out of our business and leaving our company. What can I do to prevent it? Send him the rate confirmation with the brokers info blocked out? Not sure how I should go about doing this and how other companies do this.
The driver is an owner operator so we are only dispatching for him.

Just write up your on rate sheet with the rate you agreed to with all the necessary information he needs to load & deliver

Have him sign a non-compete clause as a term of employment. It's basically a legal document that states that he's not allowed to bid on your contracts until XX number of years after he leaves your employment. A lawyer would draw one up for you or I'm sure you could find a blank one online that you just fill in the names ands dates.

A dedicated load secured through a broker which you want to double broker and not get stabbed in the back. Pretty much sum it up?

Just take a blank page write the pickup and delivery places, rate, pickup and delivery times, everything you find on your load sheet and send it to him. Simple

Ruthless and Ben Grinev Thank this.

So, is he leasing his equipment to your company or are you double brokering the freight? If double brokering to someone who has his own authority, then I think he is free to bid on that freight the same as the original broker.

So, there will be a trip lease for each load? I'm no lawyer but, these things can get sticky real quick in the case of an accident. If he doesn't have authority then he is in no position to compete for the freight nor to haul it for you without a lease agreement of some kind. I bet the shipper has no clue about this arrangement. Is the broker involved or aware of the plan?

I don't understand this trip lease for each load? But there is a lease agreement that he signs, I have done this to other drivers but I'm only asking now because we do not know him (our other O-O drivers are close friends, they still signed a lease agreement and both of their trucks are leased to our company.) He will be driving under our authority with his DOT (I hope this makes sense I'm new to the trucker world). The broker (not shipper, we are not brokers yet) knows that we have other drivers in our fleet, we are double brokering.
I really hope this is making sense my trucker slang/vocab is not so good, just getting into this kind of business and trying to learn as fast as possible.

The only reason he wants to work with us is for the connections we have with good brokers.
