i need help

    I own a trucking company and I have 1 truck with a driver ,but I just got a new owner operator that wants to work for me ,but he has his own authority and cargo insurance. He wants me to book loads for him with my mc # is this illegal and can I do this if I am not a broker ???
    please someone help me !

    If he is using his own insurance then why he wants to use your MC number for loads. Doesnt make any sense. Unless he is hiding something.

    he has a DUI couple years ago and no insurance want to use him that why he had to open all this ???This is what he told me ,but I fell like something is not right ?

    Most brokers won't let you interline or rebroker a load. So, you can't let him run a load on his authority that you acquired. If you're giving up your own excess freight to him, be aware that your customer will look to you for any failings he may bring them.

    If it is this way then tell him to become lease O/O, it will cover you as well. Also how can he uses his own authority if he doenst have insurance .. Everything is attached to insurance .. Plates, authorities.

    He is 60 years(truck driver for 17 years ) old man that I know for a long time and he opened his own mc ,because when he had the DUI no trucking company wanted to hire him as a owner operator ,because you know how insurance goes up when you have someone with tickets or any kind of violations .So this is why he got his own authority so he can get cargo on his own .But I nor sure if I can give him loads and not add him to my insurance policy and use his cargo .I just like to help him but at the same time I don't want to get in trouble I just open my authority and still new in this .:)

    and also he has no idea how to book loads ,this is why he wants me to do it and he will pay me 10% of the full price of the load ,but everything will go thru my factoring company I guess ?

    Insurance is attached to MC number ( which is given to a particular company), MC number is attached to US dot number. So how can he use his own authority with no insurance. I would suggest use your company authorities and charge him 20 % which will include the cost of liability, cargo, plates, IFTA.

    But he has all this he has cargo and liability and all of his permits and IFTA ,IRP all he want is me to dispatch him ,but I can not get book loads under his mc ,because it will get too complicated .I am not sure if its legal for him to and me to driver with my USDOT number and his cargo ?
