I'm talking with WEL Companies and I was upfront with my recruiter (whose great) that my former company is reporting 5 preventable incidents to the companies I've applied for. But she and I have my DAC and its clean. How can I dispute this with my former company? Why are they withholding this information from my DAC?

you NEED to contact your former employer and have them explain that to you.

If you do not have the 5 incidents , then you need to hire a lawyer to send them a cease and desist letter. If you did have the 5 preventable's, then of course they count as accidents . If you want to dispute any information on your DAC Report, then you need to contact Hire Rite @ 866 - 521 - 6995

I read your question several times and I now see what you are asking. You have 5 incidents being reported directly from your past employer to WEL. These are not on your DAC.This can happen because WEL is following 391.23. this post is a great reason I tell people to stop worrying about DAC. 391.23 is what will get you. My main question is this. Is that report of the 5 preventables accurate? If it is you are just going to have to deal with it. If not get it fixed.

They’re either being spiteful or ya REALLY did have 5 incidents. REMEMBER, all companies don’t report to DAC, but that doesn’t mean those 5 incidents never happened...

Why would you want this added to DAC? Ask WEL to provide you with the "request information from previous employer" form they got back from the former employer that's reporting the incidents. You have a right to know, and subsequently dispute any incriminating and/or inaccurate information. It's Federal law that these forms are done as part of your background check/pre-employment screening process by a new employer.

Your former employer has not reported your incidents to dac but has reported them to the potential employer?
And you have told your potential employer?
Right?
Seriously here is what I would do ... I would ignore all of it as a potential employee.

A DAC report is a paid for service. Your old company simply declined to pay. All that means for you is there is a bit less information for a company to find about you. This is a good thing for you.
As for them stating you had 5 wrecks, did you? Don"t use weasel words to make it sound less than it is. Did you, in fact, cause damage to something? And did you do it 5 times while employed there?
If so, they actually have to state you had those wrecks by law. FMCSA 391.23
If you did not actually cause damage, you need to get a lawyer involved.Last edited: Oct 11, 2018
