Solid ABS light on trailer, entire abs system down on trl

    Does anyone know what the regulations are on a trailer where the entire abs system has failed and the trailer light is lit up solid? I did talk to a DOT officer that said I would be put out of service if this was discovered during an inspection. I had a mechanic try to convince me I could drive with the trailer like that. The abs control module is toast. I was curious what the fines, CSA points etc were.

    Inoperative ABS is not an OOS violation, but it can be written up as an inspection violation with associated CSA points and fines.

    The regulations do not stipulate that the ABS must be operative, only that the ABS light be operating as designed. I received an ABS light violation in Virginia during an inspection because the light was on continuously. I submitted a data-q challenge against the violation, and stated in the challenge that there was no regulation that specifically stated that the ABS be operable, only that the light be operating according to the rule specifications - which it was. The data-q challenge was successful.

    How can you be put OOS anyhow, that is a trailer issue, not a tractor issue, you DRIVE the tractor and PULL the trailer. I ask because I do not know, but logic (I know, careful now, logic you say?)would dictate the trailer be put OOS until repaired properly, while you are free to go.

    Why not just repair the trailer and be done with it?

    Because the the part isn't available until Monday and the load is hot.

    Ahh, that is a pickle! Any attempts made to locate a used one nearby, is that a possibility even?

    just open up the instrument cluster and pull the bulb for the ABS light.

    you do know it's national brake check week and that you are in more trouble for disabling the light than leaving it on right?

    You will probably have difficulty convincing a judge that an ABS malfunction is the "proper operating condition:"


    ABS is specified under 393 -- 393.55 to be exact.

    One of the reasons Amtrak just won a $15 million dollar judgement against the trucking company in Nevada that ran one of their trucks into the side of an Amtrak passenger train in 2011, killing 6 people was a disconnected abs light .

    I received a ticket in NY state for ABS being on.Was cited as ABS malfunction.Ticket was made out to me,not the company.Had 24 hrs to get repaired and proof of repair sent to court to cancel ticket.
