hey guys. I’m looking for some suggestions on how I should proceed with this.

So early this morning, I was delivering meat and produce to a Walmart location in Georgia. (I’m a dedicated swift driver hauling Walmart trailers.)

I open up my trailer door and it’s clear the guy is having a bad day because he’s cursing about how terrible the equipment is (the electric pallet jack wasn’t working correctly). I pull out my phone and start recording because it’s a funny sight seeing some 300lb dude getting upset on the job. A few minutes later, he hits the pallet jack and starts yelling how he hates Walmart. So he stops using the electric and uses the manual. All is going well until one of the pallets is stacked way too high and gets stuck towards the end of the trailer door. He tries jumping to knock the box of goods down but can’t do it, so he grabs the metal dock bar and starts violently stabbing it. After realizing that it’s not coming down, he yells #### and throws the bar in my direction and it ends up doing a good deal of damage to my leg. I tried my best to get out of the way, but it was so unexpected.

I hit the ground in pain and he immediately says he apologizes as he didn’t see I was there. I was on the ground for a good 10 minutes. I was able to get back up, but I was limping. I called swift and reported what happened when I got back into the truck and they told me to come back to the terminal immediately even when I had 2 more stops. I get back to the terminal and my dispatcher said that one of the Walmart personnel said not to say anything as they will take care of it.

What should I do guys? I have video of him throwing the pole and I drop the phone because of the pain. I like my job and don’t want to jepeordize it by going against Walmart’s orders, but my leg is in a good deal of pain. Luckily I was in an automatic because I don’t think I would have made it back to the terminal in a manual.

lawyer up, you were assaulted. you can now own walmart. sell it all off piecemeal, and become a gazillionaire.

either that, or wimp out, and accept the $1.99 they will offer you.

This is what I am thinking. But what happens if for whatever reason it doesn’t work out in my favor? And Walmart already said to not say anything as they will handle it themselves.

Just worried because this job is my only source of income and if I go against their orders, then what?

lets pretend this is 1982- Ya know When Life was Better......

worker-"Are you ok?" "Sorry about that, let me help you up,Lunch is on me"
driver- "Appreciate it, Yeah I'll be Fine, let me walk it off,Get me a few aspirin please"

    worker"Burger King ok?....Heres $50,Sorry again,I didn't see you there"
driver- Forget about it-lets go eat Then I gotta get down the road"

fast Forward to 2017-Cameras,Lawyers,and people getting under your skin constantly

SURE,Life has gotten better over time.........Now Back to this predicament you have-

What in the He11 are you doing standing near AND Filming a guy who's having a bad day??
    Answer me that......

I'd be Pizzed off too If I had some Driver Filming me while I was trying to Unload his garbage out ofd of 53' trailer when I was having a bad day to start with

And for a Metal Bar to incur what you call "Serious" injury- You Had to be virtually right on top of him within 15-20 Feet away!!!!

No, I DONT FEEL BAD FOR YOU-

You were injured on the job by someone else. WM is out to cover their rears... What happens later 6 months from now when you have other issues with your leg? Seek legal advice..

Dude, mistake one is you left and got back into the truck, I would have been screaming in pain and demanding they call ambulance to take you to the hospital while laying on the ground.

In the mean time I would have told the sob to get his manager, and the store manager, then tell them to call the cops.

I would no have called the company until they did those two things and if they didn't I would have called the cops and NOT MOVED OFF THAT DOCK.

Get the authorities involved right from the start to make a case against Walmart.

You would not have an issue finding a lawyer, crap I would expect you get a few stopping by while you were in the hospital.

No excuse with that guy, bad day or not, I would have gotten his ### fired before the day was out. you shouldn't even worry about the company or the work, Walmart will overlook any issues with you and your company, but they will take that assault seriously, especially when he is damaging there property.
