Just had to call Baxter Bailey and send these clowns to collections.
Checked their credit before hauling the loads at the end of June...all appeared okay.
Hauled a load from Anaheim, California to Phoenix, and another from Phoenix to Denver.
First load was on 6/22/12, second one was 6/25/12.
Both loads were partials, total amount for both loads was $1,750.
Called at 30 days, they said check would be cut and sent the following Tuesday.
Called at the end of the following week when no check arrived and was told they 'were experiencing cash flow problems due to some late paying customers.' Asked to have them write a check right then and there, asked for the check number, asked what the total amount would be on the check and which invoices it covered to make sure it was for both loads.
Check arrived three days later, deposited on 8/31/12 and it was returned insufficient funds on 9/6/12.

I'm calling the shippers next to give them the information.
For those who have never used their services, Baxter Bailey is worth a look. You can set up with them to collect if you ever run into a similar circumstance(s) - they only get paid if you do. They will also put you on a weekly email list showing brokers to avoid.
At this point, I most likely won't get paid through any other recourse, so even if I get 50% of my total invoices, I consider that a win.
Y'all be careful out there.

You don't mention checking their bond in the credit check process or filing on their bond subsuquently. Did you do either?

No, I didn't do my due diligence and check on their bond. I normally do, but of course on the one load I take because its getting late on a Friday I rush through getting set up with them and did not check on the bond.
Update - after calling the shippers I hauled for and after calling Bailey and Baxter, I got a call from their accounting department. It seems there was indeed a cash flow problem - thing is, they lied to me and said they had called and left a message that the check they sent might come back NSF. That NEVER happened, and there was no email, either.
Regardless, yesterday I totaled up my bank fees, time spent dealing with this nonsense, and the percentage I would have paid Bailey Baxter had they gone through the process to recover the money (they had begun the process, so I was on the hook for their percentage already). I sent a new invoice to A2Z, and they agreed to wire the funds directly to my account. The person working in accounting wired all the money owed to my company from the two invoices, plus my additional fees incurred by their NSF check. He had to forward the amount I included on the invoice for Bailey Baxter's percentage to the company owner, along with the invoice Bailey Baxter sent me.
I will report back on here when this reaches its conclusion. I understand these things happen, especially in the current economic situation we all face, but this was a major inconvenience at a time when I really couldn't afford it. Thankfully my tractor payment hadn't already automatically been pulled from the account, or I would have been looking at even more fees than I had experienced from my bank up to this point.Ole school trucker, SHC and rollin coal Thank this. -

You could've skipped the collection company and filed against their bond. It shows them that you mean business. I always get paid quickly when I file against bonds, even if the broker didn't feel like paying. As an example, I hauled numerous loads for coyote logistics, it was during the busy season for pepsi and coke. So this coyote rep started this strange technique to not pay detention until pepsi or coke approved it, a process that could take up to 30 days.. she says. I played along because they paid good. nearly all loads had detention, I received detention on all of them except the pepsi ones. She tried to claim that pepsi won't pay because we had no appt and no detention approval form from pepsi. I knew about pepsi and detention from prior experiences, but also knew very well my contract with coyote. I resent the POD, invoices and this page of the coyote contract to the rep, accounts payable and their bond. I expressed that I value my relationship with coyote, and also expressed how important it is for them to fulfill their contract. I was polite and professional. The response came about one week later from their bond saying coyote will go ahead and pay the invoices in full. My contract here is with coyote not pepsi or coke. I don't care whether pepsi paid them a penny or not. View attachment COYO.pdf
The bond is there to protect you, so use it. Only use a collection company after all efforts are exhausted.

we are in same boat as you were only we still havent gotten paid yet. the company is located in scottsdale AZ off of camelback rd. so we go the business location address just to find out that they lock their doors while they are inside looking at us threw the window. we've called them many time just to be told the check is in the mail and was giving a check number but still not in the mail now for the pass 90 days. we did find out that the building they are located in has been sold and need to be moved out by Nov 2012. also found out we are not the only one with this problem. their bond is no good. it is only worth ten thousand and there is alot of other truckers who have already file againts it. so here we are still trying to get paid. the owne who is richard aman and his family will not return are calls. so i do agree "y all be careful out there"

I have had to turn 2 over to Baxter Bailey Dundie Transportation owes me $2800 and Piedmont Logistics dba Clarity owes me $5400 so far I have recieved $125 from Baxter Bailey where Piedmont Logistics dba Clarity paid $250 Baxter kept 50% for their fee. And I wont do business with Mode Transportation due to the fact that they brought out Piedmont Logistics dba Clarity and IMO if you buy a company you buy their debts as well as their accounts receivable
