Drug Screen Refusal LIE by Prev Employer

    Why didn't you do the drug test ? Isn't it better to do it when your home instead of taking time out from the road to do something that takes you away from making money.

    Next time go take the test. Regulations say you have something like 3 hours after you've been notified. If you say no, it's a refusal/positive.

    You would have had to log line 4 also, you would have had to restart your 34 again.

    SAP is substance abuse professional (may be program). Unfortunately refused drug test is just as bad as hitting the pipe in FMCSA eyes.

    That is a definite refusal. You have 2 hours from when you are notified to go in for a random. I notify my drivers face to face...calling someone up on hometime is rude. Unless there is reasonable suspicion or an accident involved, drug tests are not as time-critical as they're made out to be. If your employer is smart, they'll have multiple locations who can handle the testing for them (eg. Quest Diagnostics or similar).

    edit: The reason you cannot do it when you return to duty is because then it is not random. You knew it was coming at that point.

    Quest did ours. Drivers had the preprinted forms in truck with ID card for each driver along with book of locations. My trucks had gps locaters on them so if I knew driver had time and was close I'd call them and say cup time lol.

    If this happened in April, why are you waiting until now to fight it?

    I feel for you but now all you can do is complete the DOT requirements (counseling, rehab or whatever) and try again. Good luck to you.

    doesn't matter if you're on home time or your ten hr brake,you get called in you must go that day.I dont think its right but that's the law.only advice I have is find a company that doesn't use DAC.
