A Loop hole? Really a loop hole? Really?
Let's look at loop holes:
Say a gov't agency wanted to limit an individuals court docket time by issuing citations that are deemed a civil action.
Civil actions or civil law was developed to be used to settle disputed between two independent parties where there is no 'crime', 'law', or 'ruling' broken.
So, if a gov't actor(DOT, state police, sheriff, FBI etc etc) can deem a citation civil... Shouldn't the accused be able to civilly sue the citation issuing officer? According to civil law... YES!
But wait, the citation issuing officer will evoke state or gov't actor status... which negates anything 'civil' law stands for.... thus, to sue them(citation writer) would mean suing the state or federal gov't.
Talk about playing the loop hole like a violin.
Yes, I do actually think about stuff like this and it makes my wanna take the LSAT and go to law school.
