Hours of service delay backed by members of Congress

    Siding with the American Trucking Associations and its request to delay the changing hours of service rules set to be implemented in July, four key Transportation committee members from the House have penned a letter to the Federal Motor Carrier Safety Administration asking that it postpone the rule’s effective date until a court case between ATA and FMCSA has been resolved.
    The two parties were in court March 15 presenting oral arguments in a U.S. appellate court in the District of Columbia Circuit. There’s been no word on when a ruling will be made.
    The letter sent to FMCSA was written by Rep. Bill Shuster (R-Pa.), Chairman of the House’s Transportation Committee, and signed by Rep. Thomas Peri (R-Wis.), chairman of the highway subcommittee; Rep. Nick Rahall (D-W.Va.), ranking committee member; and Pete DeFazio (D-Ore.), ranking subcommittee member.

    You know the only real problem with all these rules is that nobody takes driver pay into consideration. If they would mandate detention pay and require companies to pay a min wage like $.38 a mile then we would not need to try to fit in so much driving.

    The congress is an interesting group of non-useful idiots. On one hand, they pen a request to FMCSA to delay implementation of the HOS, and on the other hand, they brow beat FMCSA just a couple of weeks ago to get out an EOBR mandate by fall. And given the propensity of the FMCSA to do whatever it likes, I am willing to bet that Anne Ferro over there read the request about the HOS and replied something like...."Thank you for sharing. Now, go take a long walk off a short pier."

    Given the quality of folks we have in the Congress, is it any wonder that all these government agencies pretty much do whatever they like?

    The new HOS rules are not really that big of a deal nor is the 30 minute break every 8 hours. The big deal to me is that lack of s structured pay scale, the lack of overtime pay for local drivers, and the need for federally mandated detention pay.

    Hasn't happened since the adoption of the Fair Labor Act, so it is not even on anyone's radar in the legislature. Wouldn't do me any good anyway since I own the truck.

    No matter what's being paid per mile, it will never stop anyone from driving more. If anything, higher payscale will give you an incentive to drive more. Detention will never even be considered by any form or government.

    I respect DeFazio . He truly is for truckers . He really blasted the CEO of Schneider during a House Transportation Committee hearing . Told him if he was trying to drive the driving profession to the poverty level he was doing a good job of it .

    Don't you think the bigs guys goal is to drive rates down low enough for long enough that there is less competition then increase the rates at a later time. Means more profits for the company, and by that time the drivers will be happy with any increase in wages.

    We won't see that in our lifetime . We're still at 1980's rates now .
    Even if rates go up so will fuel , equipment , and insurance costs . Driver pay will continue to be the only expense that can be controlled
