    Ask a lawyer, you need to talk to one about it and ask them about the liability of the 'trainer' because he is the actual responsible party, not the company.

    Who knows, as someone mentioned, you may be in your own truck from all of this be an O/O.

    There is no law or any FMCSA regulations that prohibit or prevent anyone from being in the top bunk while the truck is running.
