Morning brothers. I have questions regarding EIN number. So im trying to move my trucking company from Texas to Maryland. I was just wondering if I open anther llc in Maryland with new EIN number. Will i be still able to keep my authority. ? Anther question does FMCSA let you update your EIN with anther one. Trying to move but seems like its alot to deal with. Any help would be appreciated. Gentlemen. …
Why don't you register your LLC as a foreign entity in Maryland, maintain the Texas presence, and just keep everything intact? The best thing you need to do is find a lawyer who does this exact thing, they do exist and they can do workarounds that you and others can't think of.
Thank you seem like a good idea. Not sure . But I wont have physical address in texas. Would a ups address work for example. If i get something like that. Not sure if fmcsa would accept ups address or once i have to renew my registration in Texas.
Well I don’t know if you need more than an office address for a presence but it can’t be a ups address. one reason why you need to get a lawyer to represent you for this, he/she can provide a legal source for a presence. I bought a company that I used this scheme to cover legal matters for 14 months until I moved all the assets into one of my companies, I sold off the authority with the llc intact to a domestic (in state) company, this all made it really simple. They are still using the authority. one reason why I avoid llcs is the transferring them can be a pia. I like c corps because they are simple to move.
They don’t let you change your ein number. You could add one if you were previously using a ssn. I really don’t see why you can’t just register your business in MD without changing anything. Imo, the ein stays with the company. Then just update details on your MCS-150.
thank you. Very helpful. If i do that im Not sure if texas would renew my cap registration without physical address. Also with Maryland address on my driver license.
MD has a load more taxes than TX, so I don't know why OP thinks this is a good idea? Have you talked to CPA or accountant about what will literally cost you thousands per year?
