30min break for Local

if your a local driver that drives less than 250 miles/daily, do you have to take the 30min break?

 

I drive for a company like that, and they reminded us that we have to take one everyday between the 6th and 8th hour every day, no matter what.

 

When I did local, they said we had too showed we did. Boss man quoted the "showed" cause he knew we don't take breaks

 

ya have to take one before your 8th hour whether your local or not providing you work at least 8 hours that day

 

If you are running a 8/70 log...yes.

 

NO a short haul driver does NOT have to take a 30 minute break.

The following is the FMCSA’s statement on the provision:

Effective August 2, 2013, FMCSA will no longer enforce 49 CFR 395.3(a)(3)(ii) against any driver that qualifies for either of the “short haul operations” exceptions outlined in 49 CFR 395.1(e)(1) or (2). The Agency requests that State and local enforcement agencies also refrain from enforcing the 30-minute rest break against these drivers. Specifically, the following drivers would not be subject to the 30-minute break requirement:

 All drivers (CDL and non-CDL) that operate within 100 air-miles of their normal work reporting location and satisfy the time limitations and recordkeeping requirements of 395.1(e)(1).

 Non-CDL drivers that operate within a 150 air-mile radius of the location where the driver reports for duty and satisfy the time limitations and recordkeeping requirements of 395.1(e)(2).

FMCSA will also be initiating a rulemaking to include text in the HOS regulations noting that the 30 minute break provisions do not apply to short haul drivers.

We take one at or before 8 hrs if .. we go over 100 miles from our home terminal, or, if .. we're going to drive after 12 hours on duty

Takes me just under 8 hours to run my schedule. I normally stop at the Waffle House in case i hit traffic. I consider myself shorthaul but it's required for me to have a 30 min break in 8 hours. I normally get scattered covered chunked diced smothered. Takes me about 45 to 50 min to eat and drink a few cups of coffee. Adding the extra time to park and get caught back up to speed on the big road. The 30 min puts me about an hour behind

 

Then again, if it's required, I'm not behind. I kinda like stopping at the Waffle House every night.
