Advice for a driver in a bad situation...

    Let's get to the bones about this.

    You are a 1099, which you shouldn't be.

    He isn't your friend.

    I would start with filing with the IRS over the classification you have - 1099 and have him pay your back taxes and the other taxes that are due.

    I would also leave without notice. File with the state for the back wages or if you are in a state where you can't, sue him for it, you should meet small claims requirements but if you don't, sue HIM in court and ask the judge to attach YOUR legal fees to a settlement.

    IF YOU DON'T HAVE THE ****** TO DO THIS, THEN WALK AWAY AND FORGET THE MONEY.

    And here is the thing you and others have to learn, which will piss you off - YOU Have no friends who are your boss. You have a boss who was your friend. He doesn't give a crap about you, if he did, he would have made sure you get paid.

    Never work for a friend or relative.

    DO NOT work for a company like this one where you have POS owner in the future. 90% of 1099 companies out there (there are thousands) are low life POS owners who don't care about the driver.

    There are many 1099 companies out there that do it right, I am one who has 1099 drivers, and all of us who do this right abide by two strict rules, one is giving autonomy to the driver, and the other is the DRIVER ALWAYS GETS PAID BEFORE ANYONE ELSE, ESPECIALLY THE OWNER.

    I think the time has come for you to contact an attorney. Best to start the cash recovery procedure BEFORE he files for bankruptcy (and trust me, he WILL soon be filing..). Suggest you'll accept $5k out of the $7k he owes you right now and you'll forget the rest, as a good-faith gesture. If he accepts, RUN with the money and cash the check THAT DAY; he might file bankruptcy right afterwards, at which time your uncashed check will be held until the case is settled, often for pennies on the dollar.

    If the pos owner files for bankruptcy, a good lawyer will get that separated out of the debt and pursue it with the court that the owner has to settle with you on the wages. This just happened with a driver who was stiffed out of $12k, the owner filed for bankruptcy and moved to liquidate the company assets but the court removed what was owed to the drivers and made the owner pay.

    Look to Chicagoland if you want to make more money I know some people's who know some people's that pay good but you gotta haul ###. They were paying up to 65cpm I don't know what they are paying now but if you want to make more 1099 is allways an option
