Dispatcher tries to force driver to drive tired. *MUST SEE*

    Pretty sure Condo doesn't expect companies to run like this or think it's right. He's simply relaying that this is typical of how refrigerated companies from that particular region of the company operate. I can appreciate what he's saying, and while I don't fully agree with everything, I don't disagree. Too many companies bend over backwards to meet customer expectations. I'd also add that you can't place all the blame on company for not giving him the dispatch/preplan earlier. Oftentimes orders aren't communicated to the company in a timely manner, or another driver refused/quit/termed/got delayed/was placed OOS or a thousand other reasons.

    Drivers clearly should not operate while ill or fatigued. That is the bottom line. Nobody should ever have their job threatened for not wanting to work. I had a guy last weekend that wouldn't do a run for me that got sprung on us last minute. So he "left his phone at home" and called the owner. He's still employed and someone else got $300 bucks for 6 hours of work.

    I don't agree with it one bit. I'm just trying to explain how it is. This isn't an isolated incident. Try to do this crap with failing health like I've done for 3 years. I'm an expert at backing up logs. Maybe it's a wake up call before any of you try to go into the business. It needs changed but when you have big business calling the shots heads tend to turn the other way.

    Sly, K&B is an exclusive meat hauler. You haul a meat load out then bring cheap general freight back to do it again. You might run a triangle but the name of the game is get back to the next meat load. Occasionally your backhaul might be frozen or produce These meat loads general pay $3-$3.30 a mile.

    Meltom knows exactly what I'm talking about. We worked for the same company and he's the one that got tangled in the mess of it in log compliance.

    I am pretty sure that dying on the road or killing someone and then going to prison is a lot more costly for everyone than to play it safe. At least you'll be able to make some money when you are alive. For me, my family depends on me. If I die or go to prison, then they're screwed. I rather have a dispatcher chew me out than to have my family go to ####. You may want to try that Supertrucker ######## by cheating on logs and driving while tired, but I am not doing that. The reason why we have these laws that people like you are always ######## about is because people like you who are cheating on your logs, driving while tired and then you get caught or kill someone. I wasn't the person in this video, but if it was me, I would tell the dispatcher to shove it. I don't know if you ever heard of the quote "No load is worth my life." Yeah, it applies to everyone.

    Here's the bottom line, guys!

    Regardless of whether the driver "set them up to look like clowns" or he was legitimately unable to sleep for 20 hours and too tired to drive the next night, the point is that COMPANIES ARE FORCING DRIVERS TO DRIVE WHEN THEY ARE TIRED, DRIVE WHEN THEY ARE OUT OF HOURS, OR DRIVE ILLEGAL AND/OR UNSAFE EQUIPMENT EVERY SINGLE DAY OF THE YEAR!!!

    WE HAVE ALL HAD IT DONE TO US! THEY BEG, MAKE EMPTY PROMISES, CAJOLE, PERSUADE, THREATEN, AND EVEN TERMINATE DRIVERS ROUTINELY!!!

    IT IS STANDARD OPERATING PROCEDURE FOR TRUCKING COMPANIES.

    THE COMPANIES DON'T GIVE A #### ABOUT THE DRIVER OR HOW TIRED HE IS! TRUTHFULLY I DON'T THINK THEY GIVE A RAT'S ### ABOUT SAFETY EITHER!!!

    THEY JUST WANT THE #### FREIGHT DELIVERED! NOTHING ELSE MATTERS!!!

    IN MY NOT SO HUMBLE OPINION, IT IS ABOUT TIME SOMEONE GREW SOME TESTICULAR FORTITUDE AND STOOD UP TO THE BULLY TACTICS OF THE COMPANY!!!

    UNLESS YOU LIKE BEING BULLIED AND SHAT UPON BY EVERY TOM, ####, AND HARRY THAT WORKS IN SOME CRAPPY CUBICLE AND HATES YOU AND COULDNT CARE IF YOU LIVE, DIE, OR KILL A MINI-VAN FULL OF KIDS, IT IS TIME TO START SAYING NO TO THEIR BRAVO SIERRA DEMANDS!!!

    QUIT BUSTING THIS DRIVER'S GONADS! AT LEAST HE IS TRYING TO FORCE COMPANIES TO CHANGE!!!

    NO WONDER DRIVERS ARE ROUTINELY RECTALLY RAPED BY THE SHIPPERS, BROKERS, DISPATCHERS, LEO's, MEDIA, AND THE PUBLIC AT LARGE.

    WE CANT STICK TOGETHER ON ANYTHING!!!

    Although I side with the driver,you are right. It's a federal crime to record a phone conversation without informing the other party you're doing so. It's called wiretapping. The only legal way to get around it is to get a federal court order permiting you to do so.(ie police)

    I seriously doubt the feds are going to come down on the Utuber. If he tries to profit from it by going after the company the video could be thrown out of court. Its a different world than it was when wiretapping laws were written. These day you don't want to say anything on a phone that you don't want the whole world to hear. Someone is listening and probably recording it.

    You are assuming quite a bit here, most drivers are going to sleep during their 10hr break, that he should have known that there wouldn't be a load out for almost 20 hours is a bit of a stretch.... Let's for the sake of argument say that he stayed up during his first ten, didn't sleep, and was subsequently dispatched with a similar load....he would be in exactly the same predicament....having not slept, and expected to GO.....

    His argument with dispatch at that point would have been absurd...

    Dispatch, "what do you mean you're too tired, you just had a ten hour break!!!"

    The one's under the gun here should be,

    1. Dispatch

    2. Planning

    How are you maximizing productivity when you've got drivers sitting for 20 hours at a stretch???

    I'll bet that load was a last minute add on....

    Shipper, "Hey, this is Yada yada from XYZ meats. How you doing? Hey, listen, we're in a real jam here....have you got a truck available???"

    K@B, "I don't know, hold on.... I could get somebody, but...I'll need $4.80 a mile for all miles...."

    Shipper, "You got it, send him."

    K@B Planning to K@B dispatch, "Just got a hot load, need it covered asap and we can't have a service failure, this is one of our best paying customers... truck bing, bang, boom is sitting around there for almost 20hrs now, make sure he delivers on time..."

    He's likely covered under whistleblower protection laws. I wouldn't want to be the ones responsible in operations...that drivers best bet right now is to make the FMCSA aware of the issue....

    I know OOIDA would love to have something like this as an argument to support their driver harassment /elogs mandate case.....

    Anyone who doesn't think that operations isn't going to be sitting and watching the ten hour clock, and sending out JIT dispatch's as soon as the clock strikes 10 is an idiot.

    Why do you think the mega's want elogs, anyway? Cause they're "concerned" about "safety"....rotflmao....

    See......All you UNION haters out there could benefit from treatment like this.....

    As an independent driver....I am non-union.. BUT I would strongly encourage drivers to consider some kind of representation.


    These drivers that are treated this way have absolutely nobody standing behind them.......The FMCSA ,state,federal agencies can write the laws.........But can give two chits about how a driver is 'handled by their carrier'.......its a sad sad affair and a "no win" situation for the driver..



    Then they wonder why nobody wants to do this job...Being a Truck Driver SUCKS these days..It truly does....This occupation used to have Pride..And Drivers stood up for what was 'Right'....Not today.



    So......I truly believe Every singfle driver out here needs Representation...And im talking about ETHICAL representation...Not some OOIDA or ATA "for the good of the industry" propaganda......
    Im talking about TRUE driver representation that will NOT let what K&B transportation do what they did to this driver.
