On the same note maybe someone will finally understand how the current rules are inflexible and dangerous in some situations.

Ahh yes new lawsuits. These problems have been in this industry for a long time. All the lawsuits in the world will never stop it. What it will bring is more non effective regulations such as inward facing cameras, you know, the kind of stuff millions can be made from. What happened to this guy happens almost daily to an extra board freight railroad employee. FRA's answer, same thing, inward facing cameras and a new hours of service reform that left loopholes in it for the railroads. I hate to sound doom and gloom but I have lost a considerable amount of hope for the transportation industry. Look at regional airline pilots, same thing. Im the kind of guy that would like to think that my pilots in a good mood rather than overworked, depressed and worried about his next mortgage payment seeing that he makes $26k/year flying that jet. Think im lying, look up the pay scale on them. I guess all we can do is keep truckin and hope for the best.

While i'll agree it was wrong what the dispatcher said. Some of you drivers that want new laws etc, be careful what you wish ask for!. You just may get it and not like the results!. Me personally i want the government out of my life and out of my pocket!. Use common sense if your on your break sleep don't waste time playing games, watching t.v. Etc!. Get your sleep take care of buisness. If your not safe to drive then tell them and let the chips fall where they may. I get tired hearing drivers say i'm too tired to run when you ask what did you do on your break?. Usual response i was on computer or playing games etc. Then in the next breath "i'm not making money the company isn't worth a &^%&". Face it some of these drivers are not cut out for this job they want 9-5 jobs. Home every weekend, stop when it rains, spits some snow etc. And want to be able to bring home $1500.00 a week. Not saying this is what happened to this driver but in general this seems to be the attitude now days. Got to hold drivers hands and babysit them.

OK so riddle me this, you come in from a run and park expecting to be dispatched after your ten, do you stay up anticipating that dispatch is going to screw you and wait to sleep on your next 10hr break?

I've been following this one a bit, and to me it sounds like he did sleep just fine during his first 10. then only to be dispatched 20 miles away to take another 10hr, after which he was to wake up and go. Tell me exactly how you sleep for 20 hrs on command.

He had this load preassigned but ld wasn't ready,no reason why they couldn't have found him another load and give that load to another driver.Instead of making him take another 10.

It's a good thing I'm not near K&B's dispatch office right now, or I might "stimulate" their office backing my flatbed through it!

You want the govt. out of your life? Who builds the roads you drive on every day? The govt. Who ensures the food you eat isn't tainted? The govt. Who will pay your social security disability if you get hurt and can't work? The govt. Yeah wouldn't life be so great without the govt yeah right.

Yup. And you know what would have happened if he would have stayed up through his first ten hour break anticipating getting screwed over with another ten? He'd have probably gotten an immediate live load that had to be delivered that night. Dammed if you do and dammed if you don't. I stand by the fact that this driver did what he was supposed to do. Finished his day, parked the truck, took his ten, and got a good night's sleep.

The company screwed up by NOT UTILIZING THE DRIVER'S AVAILABILITY PROPERLY.
