DWI Dismissed by the courts seeking a bulk tanker job need your advise

It is NOT a bad idea for any professional driver, (trucks, buses, limousines, taxi cabs, all other professional vehicles), to totally abstain from alcohol 100% of the time, both on and off the job. This way, the professional driver does NOT ever have to worry about DUI's or DWI's.

I do not have a DUI or DWI. I have a one year suspension. There is no DUI or DWI on my record. The issue is I have to state why the suspension. I have no points. Is there a company willing to hire a driver with a 40 year clean driving record with a one year recent suspension?

 

The suspension SHOULD be able to be "purged" in a specific amount of time depending on the state ( which I know is 13 years in Cali) it looks to me like your "suspension" is being treated (by the insurance companies) as a DUI, that's why I'm treating it that way. After a given period: suspensions don't show up on your MVR either (again I'm only talking about ca)

i would call your dmv and ask them if they have a separate "commercial drivers dept." and if they do, ask them can you get our MVR purged

 

What is it? 30 years or 40 years driving experience? You are contradicting yourself which puts holes in your story. If you have that much experience it means you are older and should definitely know better. Convicted or dismissed doesn't matter. You have a drinking problem. What's to say you won't do it again if you haven't learned by age 60 that you don't get behind the wheel drinking.

You want advice? Quit drinking and take any job that comes your way. The laws are screwed up but they are that way for a reason. But it still doesn't work for some. You might expect this from a 21 year old or someone with an office job but not an old truck driver. If you have a clean record you have been very lucky over the years. Peace out!

 

In NC, license suspensions drop of your mvr in 3 years.......

 

I would just put on my application that I haven't ever had my license suspended. Then when you go in to your interview, explain to them what really happened. Tell them that's the only way for people to not just immediately take you out of consideration

 

Very rare for a dui charge to be brought to court without a blood test.
You say the breathalyzer was wrong, how about the blood test? Was it wrong as well?

Just because you were not convicted, does not mean you are not guilty.
example- OJ Simpson, Casey Anthony, etc.

Seems like your leaving a lot of info out of this.

If you are truly innocent, a good lawyer should be able to get that removed.
Even with the law you posted above, You were not convicted, therefore your license should not have been suspended.

Tried to research knolls law, not much info on it. Care to elaborate?

I was stopped at a sobriety checkpoint in my personal vehicle complied with the requirements to submit to a breathalyzer. I has held for 12 hours even though bond was posted. I was not given the opportunity to have a blood test or to have anyone observe me. My family members came three times to ask for my release and it was denied. The court case was dismissed because of the Knolls law which is stated on my driving record. In NC the DMV does not remove the 30 day civil suspension or the one year CDL suspension even if the case is dismissed. This law was passed on 2008. The police are judge and jury in NC. I was not convicted of a DWI. I do not have any points on my record. The lawyer advised that it would take too much time and money to have the DMV record changed and advised against attempting to have it removed.

Right now all I need is a job.

As for driving history. I have been driving since 1980. Made a mistake in my quote of years of experience.

 

forgive me if you already said it, but: Did you have ANY alcohol that night before you were pulled over (at the checkpoint)?

 

I would find another lawyer if mine told me it would be too expensive to fight a charge that I would lose my career over. Especially if the charges were really dropped.
