Failure to Stop at a Port of Entry

    I QC my safety mgr.. no answer, called him 2x, no answer, left VM.. never called me back. So whatever... I guess he can't be bothered. :)

    I just called the courthouse and asked what to do if I want to plead GUILTY.

    She says, "Just send the ticket in with the fine."
    I say.. "what's the fine, the ticket doesn't say."
    She says "Hmmm... let me check..."
    I whisper "I hope its free..."
    She giggles and says "Maybe.. lets see, nope $256. Oh wait.. what does the language sound like on the ticket? does it sound serious?"
    I read it to her... "failure to stop at a POE" or whatever I quoted it as saying earlier. (I don't have the ticket anymore to check it..)
    She says... "Oh, ok. IIts $118.50 then. Not quite free then."

    So I sent a cheque in for $118.50.. and that's all for now!

    In Michigan they are notorious for having the closed sign out late at night, and coming out after a truck that goes by and proceed to tell you the scales are open. Thought this was a rumour, but this happened to me back in Aug of 2008 at the EB I-96 scales near Webberville. I was the last truck in a line of 7 or so, sign said closed, he comes out pulls me over, and says 'The scales are open driver why didnt you stop, well whatever your reason, my policy is if my ##### has to chase a driver down, they're gettin a ticket'. I went to court to fight it, judge said tough, $185.00 fine and 2 points. We didn't have pre-pass where I was working at the time.

    you gotta watch these guys i had twice in 1 day this past week they were closed and switched to open right as i was about to go under the sign...i dont think it was a coincidence...there were trucks already in both times, and the ramps werent even close to full up. i have heard of people getting nailed on that but hadnt ever seen it myself.

    In fifteen years of this crap I have blown by two scales. Each one being a complete boo boo. The second was about two months ago. So rookies and us old dogs can do it too.

    They will charge you with failure to obey a control device. It is a moving violation that will go on your CDL 5points. It is equivalent to running a stop sign.

    I had a boo boo at the the same Id. scale a couple weeks ago. I was grossing 84,500 lb, I was permited for 86,000. what I didn't realize was I was just good for state roads and not the interstate. Officer sold me and overweight permit and said next time I'll get a $350 fine. I had a very nice chat with the 2 officers tho.
