Fine for not using elds

    Just a thought that since it is a rule. There should be listed fines. I havent been able to find them

    Implementation Timeline
    The ELD rule is being implemented in several phases:

    The Effective Date February 16, 2016 is the date 60 days after the rule’s publication in the Federal Register.

    The Compliance Date December 18, 2017 is two years from the publication date.

    After the compliance date of December 18, 2017 I believe the fines will be from the same table as currently used for paper record of duty status violations. So not having an ELD would be the same as not having a paper log, resulting in an out of service violation, mandatory shut down until into compliance, and fines ranging from a few hundred dollars up to the current cap of $11,000 (which will be adjusted periodically for inflation). That is my off the cuff answer coming from years of working with these rules as a consultant, I will try to get a real answer sometime this week.

    So if you did have paper you would have records but not complient with elds. But we all will be required to still carry paper logs for back up. Because if there is a issue they require us to document it on paper. So the fine for non compliance cant be as stiff as not installing elds. Because in there own language paper is still complient. See my point.

    I am trying to find the article, like so many you read it and can't find it. I believe if your ELD malfunctions you have 8 days to get it repaired or replaced. The article if my old brain still functions, said if it is still not working after the 8th day the truck is out of service until it is repaired. I will keep looking for it.

    Usual, I understand your point. However any way you cut it the paperlogs are still complient. In the right situations. In no way is it a violation of HOS. Because it is still documented. Can not carry the same fines as HOS non documemted. See where im going here

    First I must say. I try to run mostly short haul. Few days a year Im outside of that. Normally never get close to 14 hours. Im not looking to go full OUTLAW. But the added cost is hard to justify. This will not improve my productivity. And will only add cost.
