Got violation for not putting the taxi time on duty??????????/

    As I see it, most of you have missed a very important point. If you read his explanation about taking a taxi to the truck, then you can't have it both ways. I'm talking about DOT regs.
    I think most of you commenting on this are not on elogs. I have to presume.
    I can only think this driver is on paper logs.
    Because if he's on QComm or elogs then think about this.

    He's in a taxi, as a passenger. Check
    his truck is somewhere else..check
    hes heading towards it...check
    but his elog machine is on the truck....right?
    So how on earth can he LOGON ????? In order to show he's On Duty??? He can't. !!! Hello!!
    my message to DOT is.......you can't have it both ways.....who is right??

    also to say that ANY time your driving that truck whether it be for private use, is deemed On-duty??!!
    not so, as I've queried this with QComm. They give you a set number of hours to let you do what's called
    Off Duty- driving.....but there's a lot of disagreement on this as I will concede. Yes, in many cases now, elogs seems to be adding to the confusion.
    So it seems that logging of your HOS is being interpreted in different ways. Even some DOT officers obviously don't know.
    But in this case, I would absolutely fight it because it's ridiculous !!

    Let's say he's on eLogs. When he gets to the truck he can contact logs and ask them to change his transit time in the taxi to on duty. They'll make an entry and add a comment as to why the correction was made. We have our drivers send in a macro for change with certification.

    when he gets to the truck, on elogs he logs in, then he changes his duty status, and time to when he left the terminal, very simple process... the ONLY part of elogs a driver can NOT edit is line 3, the drive line, which is controlled by movement of the truck.

    and it is in the regs, spelled out, if under direction of the company to travel to a location, you are ON DUTY.

    VEry easy for the DOT officer to spot, driver went off duty in x city, and on duty in y city... how did the driver get between the cities?

    Depends on the settings and what the new regs do to Elogs, this could get really fun in the future.

    dot regs require that the driver be able to edit all lines except the drive line on elogs, until he approves the logs as accurate and correct.

    We all know that the rules don't make sense. But the rules are the rules. You were under dispatch and traveling at the direction of the company to somewhere other than your normal work reporting location.

    Like...


    • You must sleep with bed sheets because you can't get good rest with a sleeping bag. Pajamas are optional.
    • Co-drivers sitting in the passenger seat wears you out therefore it's on duty. The same with a drug test, pulling your zipper down is strenuous.
    • Personal conveyance not clearly defined.
    • Pre trip inspections must be completed but it doesn't matter when, even if it's a post trip... we just didn't know what else to call it.
    • Restarts must include 1am to 5am because we know all drivers drive day shift.
    • If you are an RV hauler sleeping in the travel trailer can't count as SB time but if you transport motor homes sleeping in it can count as off duty. (395.1 Question 24 and 395.3 Question 9)
    • If your EOBR breaks down you are required to reconstruct the past 7 days on paper logs. I hope you have a good memory!
    • RODS have to be submitted every 13 days! Why an odd number? Did they take a vote and this was the average? The 14th day you turn into a pumpkin?
    • A rubber stamp with your signature can't be used because they can tell if it's a forgery when written on paper but they can't on rubber. Hey someone stole my rubber stamp!
    • Your dispatcher bugging the crap out of you on an EOBR is considered on duty but bugging the crap out of you on the phone is off duty. (395.2 Question 20 and 30)
    • In Alaska you are exempt if the road doesn't connect to a highway or the average traffic volume is 499 or less. How do you get to such road? Do you stand around for a week with the polar bears and count traffic? Do dog sleds count?
