I agree with you 100%. The issue was not if you had to show the pre-trip remarks or not. The issue was the fact that it was never shown at all. This is the remark I posted about. "Personally, I haven't shown time for a pretrip since the 14 hour rule went into effect...only flag it & then show the line 4 time at the end of the day as a post trip". Now like I said you are 100% correct as per the reg but I still maintain that if you go from line 1 straight to line 3, according to your log, you have changed your duty status from "Off Duty" to "Driving". Wheres the pre-tip? We all do things our own way as long as they keep us legal. Myself, I like the fact that DOT or my employer can look at my logs and see exactly where I was and what I did for that entry. I guess it is like making a "Good" first impression. I stand a better chance of DOT letting me go with a warning if they like what they see to begin with. Drive Safe.

I would have gladly just been 5 mins late, however, I didn't get the chance. I was fired and wasn't told that I could just be late. I was trying to cover my butt. I was a new employee and didn't want them to have a reason to fire me in the future.

I refused to drive the next shift because it would have violated federal laws.... get your facts strait Autocar. This was my basis for filing a whistleblower complaint. Also, if I had just been "complaining" about the HOS, this too is a protected right that drivers have. It's no different if you walked in and said that you couldn't drive because you were ill. It would be illegal for them to fire you for that.

Well for the future of our truckers and the industry, lets hope I win my case. Otherwise companies will walk all over any one they can to get their ways. To them, they didn't care about my safety, it was about getting the work done that I needed done. I wasn't willing to break the law, so I got fired.
