As far as what you dispute, I’m no expert just learning myself. Couple things about that argument is that it most definitely absorbs some energy of the impact in a dead center hit. An off center hit by a motorcycle would be another reason for it needing to conform to factory standards.

You work for a petty, money grabbing company, whom obviously has little regard for taking care of an equipment problem. They would rather fire the driver that pointed it out and refused to operate it in that condition. I wouldn't give those losers a second thought. Move on and forget about them. Continue in the future to inspect all the equipment before you operate it, and if you see something that doesn't look right, say something about it.

Let's say you're right.
If the driver gets rear ended, the plaintiff is going to argue otherwise. How many hours are the lawyers going to bill the trucking company/driver defending the suit? Even if the lawyers work for free, how many hours will the owners spend filling out interrogatories, sitting for depositions, etc? Time that should be spent running the business will be frittered away - all to avoid spending $3,000 to replace the bumper.
Heck, even if there is no accident and the driver just gets cited it will cost almost the same as replacing the bumper.

The FMCSA has prohibited coercion by companies to force a driver to operate unsafe equipment. Might not get the op his job back, even if he wanted it. but he could possibly cause them a little grief.

Well, I'm going with Ridgeline on this one. 1st, someone running into your ICC bar, is at fault right off the bat. 2nd, if someone DID mash into your rear, it would probably distort the bumper anyway. I think it would not be a specific cause for a trooper to pull you over, but would certainly add it to the "list" at an inspection. Regarding the last sentence, it's called "penny wise and dollar foolish", and we've all worked for those kinds of places, just not too long, I hope.hope not dumb twucker Thanks this.
