New Graduate in IL, Looking for Job, Felon with 2 moving violations

    Well, here is the rub.

    if the school has used any kind of promise, even implied, that a student can earn his/her cdl and get a job driving truck, that makes them liable, they can have all the disclaimers in the world but it is there obligation to inform the student of the limitations of the cdl program before taking the money. While I agree this is a trade school situation, it is a regulated industry and part of the process to achieving the cdl has to do with knowing and being tested on regulations, so much so the manual for the cdl program is the same or closed to the same in all the states, coming from the regulatory agency itself to ensure uniformity in all the states. A good consumer fraud lawyer can take the school to court for misrepresenting their services which the state could investigate and shut them down.

    Is a cdl school required to run a background check and mvr? They may not have even known.

    I don’t know, but wouldn’t think so. As long as the student has a valid permit. I wouldn’t expect it to extend beyond that.

    As long as their phrasing is "potential to income" and "we work with several companies to assist in job placement", or something along those lines then they're clear. The only way they are accountable is if in their advertising they guarantee income and job placement. Went through that when I was 19 and finished my EMS clinical. No insurance companies would let companies hire below 21 years old to operate on the vans. The school did get in trouble as they guaranteed job placement after graduation and state licensing.

    That's what they did, misrepresent themselves. I bet the school claimed they have connections with carriers and said the student will get a job because drivers are in high demand. To be exact, there is a new case up here with a nursing assistant/medical assistant school, they said after training the student will pass their certification and get a job, they didn't say eligible for a job, but will get one. They are being sued because the school misrepresented the facts, they claimed that they were exempt and it was the student's responsibility to do their Due Diligence but in the ten people that filed, they expected a job even after passing the classes with ease. It looks like the school will lose the case, they haven't changed their ads, it still says the student will get a job.

    I thought the big driver mill mega carriers allowed like 3 moving violations? Guess not? What month of 2024 does one of the violations fall off your record, OP?
