Possible Stupid Question HOS and the 30 minute break?

    It's from 395.2(a)(3)(11)
    eCFR — Code of Federal Regulations

    (ii) Rest breaks. Except for drivers who qualify for either of the short-haul exceptions in §395.1(e)(1) or (2), driving is not permitted if more than 8 hours have passed since the end of the driver's last off-duty or sleeper-berth period of at least 30 minutes.

    It's pretty straightforward as laws go.
    As for the op, you might want to read Part 395 to make sure you understand the HOS as currently applied,
    Especially 395.3, it's really not that long....

    Its an 8 hour countdown from your first log on duty. Treat it like your 14 except its only 8 hours. When you take your 30 minute break within the 8 hour timeframe you gain back the remaining hours left off of your 14. The elog should have an option to warn you if you are getting close to any violation.

    No violations. On-duty has no limits at all. You can do 1,000 hrs on-duty if you could, but you wouldn’t have any hours left to drive. Keep in mind that I am talking about on-duty (line-4). Now, driving (line-3) is a different story.

    All the limits in the Hours of Service are ONLY meant for driving (line-3). This includes: 8-hr, 11-hr, 14-hr, and 70-hr. Again, on-duty (line-4) is not bound by these limits, only driving.

    It’s also worth mentioning that the 8-hr and the 14-hr both function as a countdown and are initiated by any on-duty (line-3 or line-4). The 11-hr and the 70-hr both function as a full tank that lessens when using any on-duty (line-3 or line-4).
