    Good Luck, and keep your head up. The dac is used against you in way to many ways. My advice is to find a reputable company by searching this forum, weed out truth from a driver having a bad day, sign on with them to gain experience, then try to find a small local, or OTR company to hire onto as soon as possible, then your DAC worries are over, because most small and locals dont report, or check DAC

    Don't consider the USIS report your only obstacle . There are tens of thousands of expereienced drivers out of work and growing numbers of graduates competing for jobs .

    Yes, USIS has 30 days to verify the info you dispute or they must remove it. Typically in a credit report situation, the company submitting the false info has 30 days to support the false info or correct the info given to the credit bureau. In this case someone submitted canviction info to DAC, I presume, and once you notify USIS you dispute the info the clock is ticking. Now I don't exactly when the clock starts. Does it start when you call and request dispute form, or when you mail the dispute form, or when USIS receives the dispute form? 40 days after you mail the form ought to cover the statutory 30 days.

    You want to generate paperwork and keep it to document they have corrected the info. BTW, the law I was trying to remember is the Fair Credit Reporting Act. Under FCRA you are able to sue for triple damages if the info source or the "credit bureau" doesn't remove the info after it's been corrected or if it's found to be false. Chances are the ifno on your record belongs to someone else and accidentally was put in your file.

    Once the 30 days, plus some reasonable cushion, has expired you want to get a new report to verify the removal of the false info. If it's still there send a strongly worded demand letter, mention the 30 day period, and mention your rights under Fair Credit Reporting Act and your intention to sue for triple damages under FCRA. I believe you would likely claim a year's wages from one of the company that rejected you based on the flase info.

    I wouldn't expect to see 3 times $40,000 as an award but the potential $120,000 award should be enough to get a lawyer to take the case and write a "lawyer letter". These types of cases are very very easy to win in court because you only have to show the info isn't true, the time limit has expired, and USIS is subject to FCRA. Remember, the phone is not your friend everything should be on paper or in an email. I'd also request USIS send you a free corrected report.
