Sure there is. I did it for several years. You get a gross paycheck and nothing else. Hurt on the job? Tough luck.

Why would it be illegal? You are simply an independent contractor. I did this for years with ad agencies because tours were done on a yearly basis. Why make me an employee? They could fire me after one day and I would have no right to sue them. The pay is usually higher because there are zero perks.

The company of course. I was just a hired gun. It was their truck, not mine.

 

Then technically by law you're an employee therefore 1099 is illegal.
