ups driver falls asleep and overturns on 95 in delaware

    Id be the first to agree that if you are sleepy, you have no business on the road with a tractor trailer, or anything else for that matter, but I also agree that these new regulations force drivers to run sleepy, maybe not in all cases, but some cases and it only takes one to cause a wreck.

    I agree, you can't regulate what people do when they are logged "off duty or sleeper". Even though a driver is allowed to log on-duty line 3 or 4 up to 14 hours assuming he has HOS available. CMV Drivers still find ways to falsify HOS using a EOBR by working sometimes 16 to 18 hours. How? easy, during that so called ten hours he/she may be off (line 3 or 4) parked in the customers secure location. he or she is waiting to load or unload. Technically violating the rules of HOS if he/she continues to perform duties related to loading or unloading during a period of rest, logged as off duty.

    At the end of his 10 hr break he may have only gotten 5 hours rest when the sun comes up. Is he ready for another 500 mile trip? I don't know but with two thermos of Black Coffee and a carton of Marlboro he may think so.

    Yep, eventually the brain must sleep....unfortunately the body may not be aware and operating a CMV.

    Anna Ferro understands everything,she's just hard headed and won't come to reasoning with anyone unless they're on her side.Does'nt matter how much more stricter FMCSA makes the HOS nothing will work and they won't dig deeper into the problem.

    I disagree. Anne Ferro doesn't understand the industry. At all. And if she does, she's in the pocket of Walmart and other megas who have worked to fundamentally change the industry in their favor, to kill competition. Anne Ferro is helping the "Walmartting" of the trucking industry.

    Interesting point. But, far deeper is the fact the entire government that develops the log hours has went over to the ATA bidding.

    It'll be along time before we find out what exactly led up to this driver falling asleep behind the wheel.Alot of unanswered questions.Was it his dispatcher that pressured him?Did he take too long of a brk somewhere now the heat is on to get that load delivered.I doubt he drove over hrs.One thing about this industry the loads dictates your hours.FMCSA needs to understand that and stop dictating us and somehow someway they need to fix that not put a leash on our hours.

    I do not believe that the ELD or what ever they use is the culprit here. I would be looking at other information as to what the work history for the driver is. Was he a regular or a day sub or temporary or what they call them.

    Many of the drivers do not know the "daily schedule".

    The ATA has been destroying this industry for years. They are another that hopes to "Walmart" the trucking industry.
