What should a driver do if accused of DUI?

Im not sure if you know the ins and outs, but he makes his own cigarettes. It cost about $1 a pack to do it yourself vs. $6.50 to buy a pack.

He bought a 1 pound bag of cut, loose tobacco and 2 boxes of cigarette tubes with filters already attached.

 

Also, I'd agree with you somewhat on this point. Although I don't think a 4' bong is "probable cause" I can almost guarantee that a person leaving this are with it isn't using it for tobacco. That is also why I don't fault the office. He knows the area, probably better than I do. I'd assume the same thing.

I know now I am innocent of everything but the lane change, and obviously the officer decided that as well. Was just wondering if I could have done something different to prove myself.

 

I wouldnt of done anything different than be compliant with the officer, dont argue too much, keep calm and do what he ask. Apparently he didnt think you were under the influence enough to arrest you and do a test. Might of just wanted to see if you would admit to something.

Make proper lane changes.

 

Every town has it's problem area's and the cop was probably acting on experience. They sell tobacco, they also sell bongs, pipes and rolling papers and if in a known drug area if you just bought a bag of pot and was out of papers where are you going to go first? I don't see them actions unreasonable but as soon as he seen you bought tobacco and had a reason to be there he should of dropped it. Did you get arrested or did he just hassle you?

Don't give people a ride in your rig if that's what you were in. Some companies will fire you if you have an unauthorized rider in the truck. You can also get fired for unauthorized use if you were on home time. Use of a turn signal should be second nature. It's the law not a convenience if you feel like it. I would have to think to not use it because it's such a habit. If you have the option of using your brother's 4 wheeler then use it. I could see that situation being worse than it was.

I too roll my own as it's much cheaper. But I buy mine at a smoke shop in a shopping center in a good neighborhood. Think about where you travel and stay away from crime areas. If not a cop harassing you it could be some crackhead robbing you.

there all sorts of scenarios that can be played out. it all depends on the cop and his attitude.

my first instance was 12 years ago. just becuase i pulled out of a bar parking lot. 10 cops from county, city, and highway patrol were there to witness. i blew 0.0 and was arrested for dui drugs. charge was dismissed before the court date. i got the luxury of being jobless while i waited for the state to give me back my license. and doing the whole expungement thing.

last year. the winds were very high. and when a semi passed me by. naturally, i swerved because the steering wheel was fighting the wind. then no wind thanks to the semi. then wind again once he passed me by. this was on teh freeway. 1 cop was called for witness. and the WHOLE I'M GOING TO BE HONEST WITH YOU crap. i told him to give me the F'n blow machine. blew. jumped in my car and left.

cops around here will give you the sobriety tests. and will force the issue to wear you down so that you fail. i'm an old man. i don't need a beer to fail. my muscles just don't have the strength you young bucks have.

cops take great pride in dui's. even if your innocent. they don't like their ego disappointed.
