That's not entirely true. States can not change any rule they want to without the approval of the federal government.. If they want to change any requirement that the FMCSA has implied they must go through a legal application for exemptions.

For example related to hazmat -The CFR 49 Transportation- parts 100 to 177 Chapter 1 - Research And Special Programs Administration, Department Of Transportation. Sub-Chapter-C- Preemption. 107.221 Determination and order- (b). The associate administrator for Hazardous Materials Safety may issue a waiver of preemption order only if he finds that the STATE or political subdivision or Indian tribe requirement affords the public a level of safety at least equal to that afforded by the requirements of the Federal hazardous material transportation law or the regulations issued thereunder and does not unreasonably burden commerce.

There's tons of these little statements in our business and you can thank whoever has to go through these. I hope you can see now that the Federal government writes the rules and regulations and you must follows those rules or get an order to change such rule or order through the proper channels. I don't claim to know all because I'm dumber than a rock, but I did take a college course on hazmat ( not 40hour course) and we had to show some of these regs. If I hadn't gone I would never know who controls what.

But is that aimed at interstate transfer of hazmat through a state or solely intrastate?

    Just curious.

Thank you your exactly right what these drivers who get lucky and live near a population where getting on with a small company is possible fail to think about when they ask dumb questions like why can't everyone be like me is not everyone lives where you do . I just got a buddy of mine a job at leavitts a company I had to have 3 + years and a perfect record to get on with he knows me and with my recommendation he got on right out of school something they almost never do there are a million variables in trucking what you need to do is work hard not hit anything and keep your record clean climb the ladder like most of us who now make 60+ did stop asking why other people can't be as smart as you

Everyone- including air, and water transport. The states can change any rule or regulation that the FMCSA puts out but they need to go through that process with the Federal Government. That's the way that the federal government sees that their rules and regulations are not down-graded. The states just can not change a requirement because they want to. It's like the drug testing and CDL rules. The cdl testing comes from the federal government. They make it mandatory that the states ask there questions, however, the states can add on to that or change them that does not lessen the safety of the program. I wouldn't want that job of the state worker that has to make legal all the changes the state wants.

Again, the reason the Fed Regs are in place is due solely on the Commerce Clause... Which covers interstate commerce... Now such things like Haz Mat makes since as one would prefer to handle that the same probably. But some States allow CDLs to those that are 18 years old but only because they are doing so intrastate and not interstate...

It's not dealing with CMV, but one can see this playing out in the legalization of marijuana in several states... Federal law is in direct conflict with the laws of the States.

Now the States might be agreeing to a few things as there are probably Transportation Funds tied to it but that is different that the States right to govern within their own boundaries.

But we can agree to disagree. ;-)

Because no one wants to hire a driver straight outta trucking school. Tell me about it. I get offers from straight truck jobs but that's not what I got my Class A for. I wanna be a super trucker. :^)

I'm getting into OTR first because it's required for experience and I'm going to a company that provides cdl training. The second reason is I plan to save 90% of my money. I don't have to worry about paying $800+ a month for an apartment when i drive otr. So that saves me at least 10k a year right there. And that's not including all the money you spend when you live in an apartment. When i'm on the road it's food that i will stock up on and put in my truck and avoid truck stop food and fast food. Then my other only bill will be my cell phone.

Trying to stack up money so i can buy a small piece of land and build a small house for myself out in the country somewhere. When i say small house i'm talking about 700 sq. ft or less. I already have the plans and will be building it myself. If i drove local it would take me over 5 years to do that. With otr i can do it in 2-3 years.

    Peelsession and Dumdriver Thank this.
