Why do I care if the company "wins" or not. None of my business and kudos to them for trying to lower the confiscatory tax burden. If you get the per diem then decrease the remaining mileage pay and dump the difference into a 401k to lesson your tax burden. DUH!!!

So let me get this straight, a company pays a driver a per deim whereby they lower the amount of payroll taxes they pay AND they charge a driver to do it?! Who woud be crazy enough to agree to that?

First off sublime you are talking out of your butt. Because not all companies charge. Mine is one of them.

Where did I say all? Hmmm? The fact that any company does such an underhanded thing is ridiculous.

A company can do whatever they want to do. Instead of telling people they are going to get 40cpm they can tell the truth and just say they are going to get 38cpm. Nobody is holding a gun to anybody's head to work. You know what you are getting into when you get in this industry. Not every minute is accounted for. Not every mile is accounted for. Same with other occupations. So please we can talk about all the other criminal things trucking companies do to stay in business. What company do you own?

Per diem is a way for trucking companies to pay you less than what your worth.I drove for JBHUNT and they said they would start me at 39 cents a mile. What they did was deduct what the per diem was and payed me 27 cents a mile and made it show i was making 39 cents a mile with useing the per diem. Why should any driver not be payed what they are worth? Why dont they pay you the 39 cents, then add the per diem to it.You would be making 49 cents a mile then.Figure it out.Per Diem is abused by these trucking companies, most of them anyway. Not all tho. Some wont use the per diem system, but then again i have learned some wont, but have ways of paying it and not telling you.My opinion the IRS should step in on this per diem system.I hope they do.10-4

Don't forget, if you're laid off or fired and were receiving per diem, your unemployment benefits are also affected.
