Being arrested on both counts would be really bad, but dui is related to actual operation of his 18 wheeler. Curious minds want to know?

Well, you know that wonderful rule, it doesn't matter if you were driving or not, if the keys are in the ignition, and you are drunk in the car, it is a DUI, no matter where you are sitting. If he was that stupid to be actually driving then he is a serious moron.
