It’s likely he shot the thief while he was trying to get away (shot him from behind).

I know you asked for a simple yes or not but I'm going with the "Don't ask, Don't tell" option.

Goes up there with "It's easier to ask forgiveness than it is to get permission."

Being alive allows you to get a good defense attorney if it's not cut an dry.

No matter what you choose, be safe.

Sirscrapntruckalot - Better to be judged by 12 then carried by 6.

I can neither confirm nor deny the presence of a fire arm in possession at any time.

I’ve been searched 3 times, in the 16 yrs. I’ve had my Authority. Twice in Ms. once in Ky. Last time in Ms. I asked what they were looking for. Answer Drugs and money, mostly money. I laughed and said, No chance of that happening. They target obvious O/Os with a nice looking Truck. The theory was, if they’re still in bussiness, must be doing something illegal.OOIDA had a good article on the subject, that included Oklahoma State Police Training criteria on how to spot O/Os that “sometimes haul drugs” it included spotting Trucks with extra chrome and lights. Fancy Trucks, etc.

Well there you go. Drive a Freightliner Cambodia with bungee cords holding the fenders on and you won't be bothered.

Bear in mind, that you are then putting your fate into the hands of 12 people who are not smart enough to get out of jury duty.
