Am I the dumdum thinking a 40 ton 18 wheeler is unable to absorb the impact of a 4 wheeler? I should know, ive taken out three of them in my life time with a 18 wheeler. Totaled two but held all of them across the bumper so they don't go spinning off to kill their people.

She should get charged. An I hate to say it but in FL especially I wouldn't be surprised if she did sue. This is the same state with a history of ####ty jury decisions. Way people drive down there in FL I'm not surprised someone was killed. Clearly they weren't taught to drive out of the same manual I was.

I gotta admit, it irritates me to see people messing with their phones while driving. Doesn't matter if a big rig, a car, a pick up, a cop, etc.

Small thing but whatever...still annoying. lol.

Ive been sued before for trucking related problems. One got a new car of her choice and a small check and the other was utterly discredited when he visited approximately 40 doctors to fill a scrip for a little bit of pulled muscle. Pharmacy recepts of filled medicines all over baltimore city in 4 days after the accident explosed him as a doctor shopper, narcotics abuser and breaking the employer's no go gauded dock area because he was 5 minutes late for the third time which will result in his firing.

He was fired anyway. Everyone laughed him out of deposition, including his own lawyer once the 40 pharmacy reciepts came onto the table from my lawyer like Ahab and the Genie in 40 days and nights.

This was 1980's tech. If it was current to todays Pharmacy monitoring board, he would have been intercepted in near real time.

Thats why I pay about a dollar 80 for a million in civil liability. And plan on adding a million each to two more catagories, such as damage I do to others. And damage I do to others property. Total increase in premium is 6 bucks.

well apparently, she admitted fault at the scene.

so now, it is up to the DA's office to fully press all charges. and that is even IF Florida has any sort of texting or cell phone use while driving laws on the books.

The prettier she is, the more lenient the judicial system will be.

Never said anything about driver not wearing a seatbelt. Could still be ejected through windshield when you have 40,000 lbs of payload push through the rear of cab. Besides have you actually looked at how the airride seats are mounted in a cab with relation to the belts. Not a lot of faith in them for me in most of them.

Just a week or so ago I commented on the exact 180 of this. Distracted (truck) driver causes fatality of a car and the family wants millions.

I wonder if this girl's family has money? They won't much longer.

I didn't think so either until I saw a video of an accident in Chicago involving a soda rig. Apparently if you catch the left front corner just right you can break the tie rod, steering box, or (pittman arm?). After that the driver's just along for the ride.
