You and the OP both need as far from trucking as you can get,statements like you just made tell all there is to tell about WHY TRUCKING IS THE WAY TRUCKING IS! GROW A SET!
I see no problem with them doing as Darkschneider stated. Any driver running illegal can be a problem to the rest of us. It is their decision to make and I would support it.
I don't agree with this guy either but bringing in the DOT worked for one of our drivers. This guy was wrong and I made statements that he didn't know what he was talking about but the company fired him for going to an outside source and he went and got a lawyer. After a year and a half they brought him back with back pay and it was like he never left the job. I don't understand because Nevada is a "At Will" state and they can fire you for any reason but being a large corporation and headquatered in Delaware that might have been the reason they had to do what they did. I believe this guy should have manned up and set the ground rules from the start. Nobody is going through my stuff and I don't care if my job did depend on it. I would have made recordings and document all his doings so I would have proof. But this guy sat back and did nothing.
<sigh> OK, let's go for broke here, alright? Where did you go and how many hours did he drive? It's sort of hard for us to help you if we don't have all of the facts. Frankly, I think everybody who has posted here has a valid point, but it depends on what actually happened as to what advice and course of action would be best.
exactly. and that being "illegal" is what can and will get you in trouble with the law. and if you are involved in an accident, especially one that results in injury or death, that being illegal will put you in the gray bar motel. I never used the word "conspiracy." I could get into laws regarding "good Samaritan," "aiding and abetting," "driving the getaway car," "accessory," etc. but suffice to say, if you have a bunch of "church" nuns splattered all over the road, a driver found to be operating outside the hours of service, and a salivating shark of a lawyer itching to sue, you do DON'T know who might end up in the defendant's seat, and what a truckload of charges he might have against him. I can't guarantee you that a codriver could be charged for not lifting a finger to stop it, but it's downright silly for you to insist that it "simply would not happen." you don't have to have malice or forethought to be charged criminally.
I think he is & I'll gladly say that I think he is a whiner. Well, actually the word sissy boy comes to mind. But I'll be polite & only call him a whiner. He's complaining already & hasn't finished training yet. Then he says daddy the lawyer is going to get involved.... Well sorry to tell ya boy, but the trucking companies attorneys will chew your daddy up & spit him back out. I don't know you or your story... But I'm will to take a guess that you never really had to do any manual labor in your life, you know since your daddy is a hot shot lawyer. I'm willing to bet that daddy influenced college & you worked this prim & proper white color job. Then ####... The economy fell, you lost your job. And at 29 years old with no manual labor experience you looked at trucking... And now your going to blow that because your whining. Like I said earlier... This is trucking. If your having problems with it now, then your obviously going to continue having a problem with it. You'll most likely be out of the trucking industry within a year. Oh... And your cup holder of piss... Did you actually watch the man or woman piss in it? I'm guessing that it is just an accumulation of water from sweating soda cans & bottles. I'm the minority.... It is NOT the trainee's responsibility to keep track of the TRAINER's log book... If anything it should be the other way around. You are correct there, but you diddn't say this at first.. You basically said that if he was driving illegal he was driving tired, which may or may not have been the case.
Not silly at all... he would be looked at as a trainee that has no true say so, especially since he is not in the driver's seat. That takes him out of a controlling position of the operation of the vehicle. Then all he would have to say is "I told him I didn't think he should do it..... he told me to shut up or he'd put me out on the side of the road...". There is not a jury in the world that would convict him. Maybe a fine and some community service, but that would be it. Think I'm wrong? Ask Cypher's dad.... I am also intrigued that we have not heard anything more Cypher as to how things are going. Last I heard, he was camping out in another truck. What's the latest Cypher?
