Trainer started running illegal

If the trainee was in the driver's seat, yep.... it would be a problem to say that..... that was not was I was referring to. I'm not even going to retype it.... go back and read what I said.

Ya know what... I am not even going to carry this on with you.... you obviously are not grasping what I am saying and you are trying to debate a "non-argument". And further, you are trying to blow this into an outrageous level.

Simply put.... NO, he would not lose his license. NO, he would not be held at fault if he was in the passengers seat and his log book indicated that he was not driving. YES, there would be a known difference between "trainer and trainee", because it would be CLEARLY defined in the courtroom. YES, the citing officer would ALSO know the difference. YES, the DMV officer would understand that the trainee was under duress not to "stop" the trainer. And for the record, I have a friend who works for the DMV and one of his duties is working at the Weigh Station in Mebane, NC doing inspections. He's the one that gave me the YES's and NO's. And one final one.... YES, I called him and asked him these questions!

And while we are at it.... Hypothetically.... how exactly would you suggest that the trainee stop the trainer from driving the truck? Should he:

• Physically remove the driver from the seat by any and all means available to him? (which would leave the steering wheel unattended)
• Phone Dispatch, report him, and the trainer is magically teleported out of the driver's seat? (which would leave the steering wheel unattended). Or get left on the side of the road in the middle of nowhere (in which case the trainer will proceed to go down the road STILL ILLEGAL)
• Reach over, turn the key off, and remove it from the ignition? (which would make the vehicle uncontrollable)
• Jump from the vehicle at 65 mph?

I'm sorry, Chief. But your argument, however eloquently put, is not real life. At best, the trainee could report him after the fact. But it is not going to stop the illegal behavior at the time of the infraction.

And in case you hadn't considered it.... you would know if you were getting in the vehicle with a drunk driver, in which case, YES, you would be able to do something about it. But in Cypher's case, he went in the sleeper and when he woke up, he claimed the trainer was illegal (which we still haven't been able to confirm). How in the world would he have been able to be proactive about this while he was sleeping?

You're making a mound out of a molehill. And I have lost interest in your attempts to justify what you are saying. I see your point. It would behoove you to see mine.

I agree.... dispatchers should never do that, and if they do, they should be reported to your safety office if it happens a second time. You should always stand your ground when it comes to that.

hehehehehehehehe for the record, I run electronic logs. I couldn't run illegal if I had to. .... but I'm still a pretty big guy.......

the trainee is not the boss on that truck. He is a subordinate of the trainer.

I can do 15 hours and still be fine. Not legal but still fine. Myself I wouldn't have had a problem with a co driver running all those hours. I have done 12-15 hour days and was local.

Thing is there was absolutely no reason for the trainer to do it.

Unfortunately there will always be those chest beating Neanderthals that want to eat pills and run WFO.

 

That was kinda my point. He even said in a previous post on this thread that he "was off the truck and blamed for everything." But everyone continues to come here offerring advice and arguing about what is legal and what's not. I think it's kinda funny myself.
