Carrier Agreement

    I am looking at a carrier agreement and it says that the shipper can substitute the name of the broker instead of the carrier on the bill of lading.

    Is this legal?

    I don't know if its legal or not but, Ive run into it from time to time. At least 1 time last week.

    They also say to hold the broker and the shipper customer harmless from any claims actions or damages including cargo loss and damage theft delay damage to property and personal injury or death.

    Does this mean if they run the forklift through my trailer they're not responsible?

    Carrier shall not seek payment from shipper consignees or 3rd parties if they can prove payment to the broker.

    So if the shipper paid the broker but the broker never paid you you can't go after the shipper?

    This is a very common practice. You pickup a load and BOL has the broker's name on it. Just handwrite your company name under it and get going

    The shipper already paid once. You’d have to file on the broker’s bond to try and get your money.
