Agricultural Exemption

    Any of y’all familiar with this when it comes to the ELD??? I have a prospective employer who runs produce from a farm to the surrounding states and the drivers supposedly don’t have to start logging at all until they hit a certain mile radius out from the farm. Just wondering if anyone uses that and knows if that is how it works.

    Here is a link that will give you all your answers, or confuse you more.
    Basically. From the spot you load, you are exempt from HOS until you drive 150 air miles from first loading point. That is equal to 172.6 mile radius on a map.
    All the time inside radius is considered Agricultural exempt.

    You’ll have to log it as off duty PC and just remark that it’s Ag exempt.

    Does not the exemption only apply to movements from the "Fields" to where ever the shipping point is to the final destination?
    The truck(common carrier) that picks up at the shipping point and delivers to the final destination cannot use the exemption.

The exception also applies to the transport of farm supplies for agricultural purposes shipped from either a wholesale or retail distribution point to the location the supplies will be used or from a wholesale distribution point to a retailer.

    We haul whey from plants to farmers.

    Within 150 miles.

    We have no eld.

    As long as the commodity is hauled in unprocessed form, you can haul if from common storage facilities (say, grain elevator), not just the field.

    We haul fish from the farm to market, and the first 172 odd miles are "off duty", ag exempt notation.

    Equally important, on the return empty trip, the last 172 miles are, once again, off the clock.

    Likewise, going empty to pickup is off the clock as well. It can all get pretty confusing, but there are a few ELD solutions now that cater to Ag exempt carriers.

    So, ya'll are saying XYZ Trucking out of, say Dallas, TX picks up a load of lettuce in Salinas headed to Dallas can log PC(exempt) from Salinas to Buttonwillow, then starts logging driving ??????????
    That don't pass the smell test.

    It has nothing to do with where the carrier is based, it’s 150 mile radius from where the load originates. Going in empty once you’re in that radius you’re off duty. And if you time everything right, go off duty and drive in to load then get loaded then drive as far as you can back out and catch a quick nap and your 10 hour break is up and you can start driving again.
