Minimum Wage=Truckers Rights ??

    Perhaps someone with more knowledge can help me out here. Believe it or not, we are kinda covered by the minimum wage laws. This is where I need the help, I don't remember exactly how it works.
    I think that for example you had a crummy week, ran 100 miles but were on duty for 20 hours. If you make .30 an mile, that would be 30 bucks. But 20 hours times a minimum wage of $7.00 equals 140 bucks. So the company would owe you the difference of $110. Can anybody help me on this, I know there is a law covering this.........

    Most drivers are not covered under Fair Labor Standards Act.

    Which means they are exempt from paying drivers minimum wage.

    Yep. If Joan (insert very derogatory rant here) Claybrook really wants us to believe she cares about our working conditions, she can lobby for us to be included under the FLSA. I think we'll see this happen right after they open up a snowboarding resort in Hell. :biggrin_25517:

    All I can find under the FSLA is that drivers are not covered by the overtime regulations. I'm pretty sure that we are covered to make the minimum wage, I just can't find it yet, but I shall..... Perhaps if not federal, maybe its covered by state ??

    yes, please let us know what you find. but I'm not sure how hourly wage laws would affect OTR drivers when we're not paid by the hour.

    Our log book is based on hours, as is our work week. If you put in 60 hours on duty, and 0 hours driving, then the company owes us ZERO ? Is this correct ?
    DANC694U, the village idiot, knows a bit about this. Perhaps he'd explain it for me.

    So what you're saying is every trucking company in this country skirts around the minimum wage law and gets away with it?

    Well, kinda like in some states, waitpeople can get paid less because of the tips, BUT let's say you have a crappy week, the employer still has to make you make min wage, but most don't. This doesn't work in states in which they don't allow that to happen because they don't allow the waitstaff to be paid less.

    Allow Me, Read into it whatever you want. I'm just trying to establish if we are covered by law under the minimum wage. And basically YES to your question.....
