Shipper Filed Claim on Reefer Load Due to Temp Failure

    Hi all,
    Got a wierd one here, so I just got a call from my insurance that the shipper has filed a claim because of temp abuse/failure. Now the interesting part is the reciever recieved the load with no issue, not a word about temps being out of range or anything. The reefer never went out of range but I have no way to prove this, the shipper also didnt put any temperature trackers. Basically, the load was grass, and from the pictures in the claim it looks like the plants were not watered and this wasnt a temperature thing, the grass is dead in small spots, and doesnt look like it was cooked like they claim otherwise all of the grass would be dead. Any advice on this one?

    No advice for the situation. But I will say this, with the reefer trailers I have, I installed data logging equipment becuase of the number times we had a reciever accept a load and then get hit with cargo claim a couple weeks later. So when the driver gets unloaded, he prints off two copies, one for us and one for the reciever. They sign the copy he keeps and gives them a their copy, don't matter what the load is, it is cheaper to get a roll of thermo paper than a cargo claim.

    Load was dropped of July 25th, claim filed yesterday. We're currently looking at installing a data logger into the trailer. Any recommendations?

    What did they do with the load? When u delivered it did the broker pay u?

    Looks like I'll avoid grass now, whenever I hear about these sort of things I start to contemplate weather to sell my reefer and leave the refrigerated part of trucking forever. Sorry man

    Yea and don't haul plants either. You deliver a plant that has a broken stem and thats like gold to the receivers. They won't say nothing either until you drive off and your insurance company calls you.

    Unfortunalty its an SB3 with no data logger on board so can't prove that it stayed within their range. I do have a signed copy of BOL from time of receiving, one of my friends recommended I reach out to the receiver and ask them for their copy of the temperature recording at time of entry and at time of unloading. This reefer stuff is proving to be a nightmare.
