Very good advice for not hauling reefer. The only thing I disagree with is I believe him not signing the rate confirmation, hurts him rather than helps him. Once he signs the BOL he is responsible for the load, but without a signed rate con its not a contract.

Deal with it after delivery, it is much easier to deal with a collection than with a cargo claim.

If I was you, would have told the new broker to stick it, the contract and customer isn’t his, it is the broker who you have the contract with.

You could also bill the consignee for the load, especially because another broker appeared out of no where and tried to hujack the load,

Can't think of any dairy product that would go that far that's exempt. If the load is late and it's dated product your insurance isn't going to cover you. Same if you hold it "hostage". Sounds like a double brokered load, first broker took it as a carrier and then gave it to you for mare than they were getting. Take the 7K and call it a lesson. You can try to go after the shipper/broker who actually had the load for the difference, good luck.Cost you more than the difference. If you never signed the paperwork and you don't take the 7K you're a fool.

I'm 99% sure that none of my rate cons or broker agreements have actual signatures on them upon receipt. I do sign them but don't think i send them back unless requested by few brokers, and few brokers send electronic rate con that require electronic signature. Is there a way to require brokers to electronically sign agreements? I'm going to be at receiver tomorrow morning when they open and wait to speak with shipper. If the original broker is scam, then only the shipper has my signature. I just need to get paid, this net 30 is killing me and i recently stopped factoring with truckstop and canceled subscription to their board, poor customer service. Though once I get my TMS software running I may have to subscribe again.

    Appreciate all the advice

october 2019 started llc, applied for authority paid insurance purchased truck cash from SWIFT, company i got my cdl and almost 6 months otr experience with. I had both DAT & Truckstop boards for couple months to see what loads were paying and comparing that to my projected $1.56 per mile expense. While waiting for California to send me my CAB card parked at Loves in phoenix i'm looking at loads and chomping at the bit. I post my truck and call on few loads to practice asking for 2.56 and more per all miles.

Cab card comes in and I get a call asking about my posted power only truck. Landstar broker offeres $1000 day for 4 days work but i have to deadhead to Denver, CO so will pay $5000. I get rate con and take off. couple hours later i get call asking eta and if I'll be able to pick up a load. I pull over do the math and let him know that I can pick up a load but will run out of time and not be able to make delivery per request. I get call back saying its ok just pick up load when I get there.

I pick up load head west on the 70 for 3 stop run but run out of time and stop at rest area for 10hour break. Little to no phone service. Wake up make 1st delivery asked where i was and told i was late by more than one person. I had to move a trailer out of the door park it on the parking lot. Spent almost an hour trying to reconnect to the trailer cause the 5th wheel wouldn't lock, learned that this was due to not being level. so happy trailers have high an dlow gears. any way after delivering and returning to shipper sat for 4 days. Calling every day 2 times a day called/emailed broker everyday also. 30 days later told that shipper didn't want to use me cause I was late to deliveries. OOIDA told me that I should have got more details on rate con and that I would most likely only get TONU. Lesson learned no rate con I don't move. I don't like whats on rate con fix or I don't move.

Most brokers offer 3% quickpay which is what I was getting. I've done the math and its not worth it to me. I'm better off fueling at mom/pop stops for about .40 less than major chains. Larger brokers provide fuel advance if/when I need. I was able to purchase 2nd truck for $29k cash at auction with money I saved to cover fuel/maintenance. Team that was going to work for me must not have believed I would buy truck cause they bailed on me so it sits waiting for reliable driver. I'm trying to convince myself not to sell it and buy new or newer reefer trailer cause the one i got is 2005 trailer with 2013 reefer unit, I've had to turn down too many <0 degree loads that were paying $3 or more per mile. I'm going to need fuel card though as I have been talking with cousin thats willing to drive for me.

I was under the impression that he signed the first Rate con.
