I don't know what not signing the rate con means in legal terms once you loaded the product. What is the legal significance of the lack of physical signature?

It is not uncommon that the brokers don't care about your not signing it. They very rarely sign it themselves before they send it to you. Technically, both parties should sign the contract.

Now when I think about it, I don't remember a single rate confirmation from multiple hundreds that was sent to me with a broker's signature.
The way it works is that they send it to you and you're supposed to sign it and send it back to them but they never send it back signed by them.
I never insisted on that but never did I have any problems either.

 

By signing it you agree to the terms in the rate con, such as the rate. Also by not signing it its not yours and can be given away to someone else before you get there. Double brokering is common, but I have never heard of the second broker paying more that the original broker is being paid for the load. Obviously the second broker is a scumbag, as he probably couldn't get the load covered, so he inflated the rate with no intention of paying it. That was why he initially refused to sent the rate con, I am sure had the driver went to the pick.uo location with out a rate con the broker would have said now all they want to pay is blank, figuring the driver would take it because he is at the pick up location.

That's why I avoid obscure brokers. In any case, it would be good to know their MC# or even better, the OP could write this experience on DAT broker directory review. That's unacceptable practice much worse than a carrier's canceling a load 5 minutes before a pick up because they found something better.

 

I agree, I don't use brokers thatbI am not familiar with unless they have bwwnnin business for 10 years or so

 

With that many hours, I would be cautious about putting a lot of money in to it. I would however get it checked out, so you don't end up having a temp issue and a claim.
