    Had the owner of the company saying hes been doing it 15 years. And it is legal.

    Being an employee and being a contractor is mutually exclusive. There is no legal way to do a 1099 employee as. That's like asking the state of water. It's either boiling, or it's a liquid (or ice). It can't be both.

    And while the IRS, unfortunately, doesn't police 1099's like they should it's still illegal. Let me ask you this. Do you want to work for a company that the very first thing they do is set you up by their illegal pay scheme? What else are they doing that's illegal? HOS, Maintenance, even pay. No thanks.

    Also, I can state I'm Cleopatra, Queen of The Nile. Doesn't make it true, even if it looks like batman posts here now. :)

    How much are they offering for pay. It should be more than a company driver since you will be paying double payroll taxes.

    1099 would be a last resort for me unless they're paying me some inordinate amount of money and run legal equipment / logs etc

    If you have good driving record and are legal to work in this country , stay away from those companies

    Lots of confusion on employee vs 1099

    You can’t be both, you are either a 1099 or you are an employee. 1099 by itself is not illegal, but it should be in opinion.

    Too many companies, including those outside of trucking, will offer a job paying “X”. Then after it is accepted they switch the offer to say it is a 1099. If you are getting paid “X” as an employee, 1099 pay should be “X” times at least 2 because you are not taking home as much pay and you have all of the risk.

    As a 1099, you are responsible for taxes, unemployment insurance, 401K, health insurance, and the list goes on and on. The company decides they don’t have work for you or that it just isn’t working out, there is no unemployment to fall back on. The risk is 100% on you.
