So this has been what’s kept me busy. Trying burn the candle on both ends is killing me. But soon it will be all over hopefully.

*LONG POST WARNING*
I have a question. One of my coworkers was comin back from Pierre SD. Cutting back down to KC he was running secondary roads to get back to the big road. Going through a small town the speed limit went from 55 to 45 to 35. He got pulled over and ticketed in the 45 zone because the officer said “he wasn’t going to be able to get down to 35 in time”. He was going 42, and lightly argued the 35 mph zone was still a ways a way. To no avail. Now, let’s call a spade a spade. All of us here are in the bulk industry, all of us know what comes with it from time to time. (Or often, as the case may be). When we pull KS loads we are supposed to be only on secondary roads. Getting to them sometimes (read: always) is the fastest and easiest. We were taught if we got popped on a secondary road with 85,500, if they ask how we got there just tell them “secondary roads” because we can not be ticketed unless we are CAUGHT breaking the law. I know this is a bit long winded but wouldn’t the same rules apply to a speeding ticket? Far as I can tell 42 is under 45, and that’s the zone he was in. Even the cop admitted he knew the driver was slowing down but there was still “no way he was gonna be able to make 35 mph.” Well how the hell does he know? The driver walked up and took a picture of where he was in reference to the 35 mph sign and sent it in to the owner of my company. Any one have any thoughts on this? This sounds like a quick BS money grab from a town that probably sees little trucks and saw dollar signs. But I’m open to everyone’s opinions. -
My only opinion is fight it, hire a lawyer if need be. I was wrapped up in a situation like that a few years back, mine was a bit more egregious, 68 in a 55, what little bit of defense I have is that I was within a quarter of a mile from the well marked 65 zone, I was still on the 2 lane which was 55, I hadn’t seen a sign stating that in a while, but still, I was doing 68 in a 55. When the officer stopped me, I was beyond the 65 zone and felt it was a little one sided, but I could see his point as well. Long story short I hired an attorney, nearly a year later it was amended to an equipment violation with no points attached, but the fine amount stayed the same. I truly believe it’s more about revenue than anything, I doubt the fine will go away, but I’m sure he can get it reduced to something with no point value.

Your co-workers situation sounds like he has more ground to stand on, my situation was a tougher fight to fight, but I had a spotless driving record prior to that day and was determined to do anything to keep it that way. At the end of the day, nearly a year after the initial citation, the officer that wrote me the ticket was more than respectful and stated he had a job to do, to which I shook his hand and told him I understood. That situation made a better driver out of me.

Maybe I’m doing it wrong, but I never dump without deflating my trailer bags. Doesn’t seem like good sense to have all that weight sitting on one inflated axle, you pop a bag you’re for sure going over.
